    • Your case shows the idiocy of employing a solicitor to do things you could easily do yourself. Had Countryside dealt with their own case they would have entered judgement on 4 June and there would have been no way back for you. But they thought they were clever by running to Rachael and Sean of BW Legal for a more "professional" (aye, right) service.  These dodgy solicitors can only make money on private parking cases by doing everything on the ultra cheap and certainly cant check the judgement date for every single separate case. Ho!  Ho!  Ho! Anyway, glad you got the defence filed OK.     • It is already trespass, nothing further needed to make out trespass. Not sure where ‘interference with goods’ helps you / how you’d bring a claim for that that stops them parking there.
    • Thanks Dx,    For some further information, the holiday was booked as a package holiday for 2. One of the 2 had to be changed, and changing costs £700 for a new flight as "tickets had been issued and they cant do a name change". I cant quite figure out how compensation works for things when it comes to package holidays.    From what I can tell  - The plane was due to land in Turks and Caicos to drop off passengers, something happened during descent, resulting in technical fault.  - The rest of the original flight from Turks & Caicos -> Montego Bay was cancelled  - A New flight was put on today, which was then delayed by 1.5hrs aswell  - Hotel was provided for the night after much hassle.  - 1.5 days, 2 evenings of holiday lost  If I understand correctly, since the original flight (LHR -> Turks -> Montego Bay) was cancelled, they are both entitled to a refund on that full flight? I can't quite work out if they are only entitled to a refund for the equivalent of Turks -> Montego Bay, or for the full LHR->Turks->Montego Bay, since it was issued as one ticket/all Virgin, and they should have arrived yesterday..?)  I can't work out how to get the cost of that compensation, or whether its a set figure, and how the loss of days of holiday is factored in   I am aware:  If you received less than 14 days’ notice of the cancellation, you are generally due compensation, awarded in pounds or euros depending on where your flight was due to depart from, according to the following scale: £220 / €250 for all flights of 1,500km or less (e.g. Glasgow to Amsterdam); £350 / €400 for all flights between 1,500km and 3,500km (e.g. East Midlands to Marrakech); £520 / €600 for all other flights (e.g. London to New York). Compensation will be reduced by 50% if the arrival time of the replacement flight doesn’t exceed the arrival time of the original flight by: two hours for flights of 1,500km or less; three hours for flights between 1,500km and 3,500km; four hours for all other flights. So I "think" its £520pp for the flight part as compensation (7500km)... but some sites say its a full refund for the flight... is it both?  Thanks,  Ryan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No news - yesterday got the 2nd 4 week wait letter, will respond by 22 June. I sent them a 2nd LBA letter yesterday by RD asking them to refund my charges within 7 days so as not to waste court time. If they forced me to file a claim despite my attempts to settle this matter out of court then I would also be claiming the interest charged on the penalty charges as well as court interest and costs. This was to give me more time (get paid on Friday and my 1st LBA ran out yesterday) and to maybe give them a chance to save time and more money. Can't see it somehow, think the general rule of thumb is that they pay up within 28 days of the court claim these days, but you never know.......

 

It seems forever when there's a chance of some money anyday and the 24 hours seem to last a week. Can't wait for payday. You heard from the court yet?

Have just been on to cank, what does this mean for all of us??? Don't know what to think now, maybe should just throw in the towel and save paying out the court costs - it'll be £120 saved for us. What do you reckon Lisa?

I think we need to find out the reasons before we can make our minds up, cank says he is going to scan the judgment so we will need to have a look at that first.

Anyway the postman has been and gone.... with him he brought a letter from the County Court. horaaaaaaaaaaaaaah i shouted as this was just a letter not like my hubbies refusal he had his papers back and a rejection. I opened the mail, and to my much disgust. the following.....

 

your financial circumstances are such that I consider you are able to pay all/part of the fee. The sum payable is £80.

Hi Lisa,

 

Just read through this thread and want to congratulate you on your good spirit when your obviously up against it big time. Yes the system stinks when good honest people need help with legal costs and cant get them bu criminals have no problems getting legal aid.

 

I hope you can get your claim going and into court as it seems the money they have "pilfered" from you would give a welcome boost to you.

 

Perhaps if the worst came to the worst you could ask the Halifax for an overdraft to pay them:grin: (sorry, just my warped sense of humour, although asking for an overdraft and when they ask you what its for, you say "to sue your miserable asses" would be funny as anything:grin: )

 

I currently have one set of papers lodged in the Sheriff Court against BoS, with another to filed on Friday, total around £1600 (2x accounts) & Im about to go after Barclaycard, Barclays, Capital One & GE Money.

 

Keep positive and you will get there in the end. Dont get to mad at the postie either, the poor guy must have a bloddy hernia carting all these statment, standard letters around.

Thats the spirit. Hey, they wouldnt give me an adult account until 2 years ago either, gave me their "spectacular" moneyback account the only moneback I'll get out of it will be the £1200 they "borrowed" from it and ended up with me having a £1400 overdraft. They are a little upset just now as I've completley stopped using it and got a letter saying the account was dormant and had to pay money in or my O/D would be revoked as per their T&C's. I paid in £50 and got a call saying that it needed more. I asked where it specified an amount in the contract (knowing full well it said regular payments without specifing an amount). They said when my O/D was up for review it would be taken away if more substantial regular payments were not made. The girl was a little pevved when I told her my overdraft does not have a review date as its a stand by overdraft which is on for the lifetime of the account & so long as I pay in a token sum each month (which I can of course take straight back out & keep inside my limit) they can do bog all.

 

They are trapped in this case by their own terms & conditions!!!

Hi there all, I have read with interest the goings on with the Haifax.........I too have had good response from them till now. Firstly I rang to request my statements, they arrived within 3 weeks (and they didn't take the money for them!), I sent my first claim to them for 2 years which I had stored in my paperless account then I sent off a second letter with the remaining 4 years of charges to be claimed back. I have had responses to both letters saying that I should hear from them no later than June4th......only round the corner I know but I have further more sent them the LBA as I have given them the 14 days to respond, no response, so am going to go via MCOL....it will cost me £250 for this but am claiming £7767 back so worth it I believe - if anyone has any advice - I would be truly grateful............Jo x :p

Hi guys, a further update, I have had a response from the Haliprats and they are saying that all charges are Justified! How! so there will be no refund. Is this the end or can I take this to court????

all i can tell you had same letter no later than June 4th.Sent mine to couurt got response saying going to defend so who knows what at moment,had alot back saying normal to be defended and usally pay out????hope so

Stick with it guys, I was paid out a couple of weeks ago in full by halifax. I was 18 days into court action, money just appeared in my account followed by a letter a few days later.

 

Keep your chins up and keep on reading, just in case it does go all the way.

 

They may be judges and lawyers in a place called court, but at the end of the day they are the same as us. Perhaps even some of them may be claiming their illegal charges back? Not likely I know on their salaries, but you never know!!!

you say they have defended, or do you mean you have received acknowledgment which states in the tick box on page 2 that they intend to defend the claim in full??

 

If the latter is so, have you sent a copy of your SOC to the address on page 2?

so just to put my mind at rest, is it a scare tactic to us as they don't want to pay out or is it really worth going to court over after Halifax have "reviewed" my request......I am scared that I will lose my money to go to court and slightly intimidated......what would you advise?...........Jo
