Hiya Everyone, I am so glad I found this site :-)

 

Am I correct in assuming that the first step is to send a Preliminary approach for repayment along with the schedule of charges. Is that right?

 

Someone mentioned a Subject Access Request, what is that? I have all my statements so do I need this?

 

Also I am putting 2 claims in, one for my personal account and one for my business account.

If you have your statements and know all your charges then there is no need for SAR. So yes you need to start with preliminary approach letter.

 

You are aware of the difference between claims for personal and business accounts?

I am about to send letter 3 (LBA) but it says "I am very disappointed that you have failed to respond to my letter" - but they did respond, they just said I can't have the money back. Is this still the letter I need to send?

I've been dipping in and out of this site since Jan but still not finding my way round to the relevant forums! I have been trying to reclaim £1400 from Lloyds TSB with no luck so far. I got a repy to my final letter before action more or less saying on your bike! I'm very nervous about taking the

next step to court action. so please let me know if you have any luck. Barclays payed out £600 after first letter!

Hi

Lloyds rarely pay out that amount before the Court action, so you should start the claim.

And please start up your own thread so you can ask any questions on there.

Hi Dannys,

 

Continue as normal.

 

There is a possibility that your claim will be stayed until after the test case, but that is for the court not Lloyds to decide. If you file now at least you won't miss out on the older charges and the interest will soon start to add up. Also there is the possibility that the ocurt will allow your claim to continue.

 

Have a look at the new template POCs specifically for Lloyds in the bank template library.

Ok, so I have the new POC from the templates.

 

What do I need to do with it, I take it I send this to LLoyds Bank?

 

What do I need to do to get the case to court? Do I go to the local court or something?

You need to fill in the N1, and take 3 copies along with 3 copies of your schedule of charges to your local County Court, this link will help:
