I have just received a letter back from Halifax making an offer for just the charges (£221).

 

The spreadsheed for complex bank charges shows £256.74 interest on charges and there is also the 8% on top of this.

 

Should I get all of this back and which letter would I send to refuse this offer as there are six different ones.

 

I have not gone to court action just yet as I got the letter on the day I was going to court to put the claim in.

 

Halifax also say I have 14 days to reply to the letter dated 18th April 2007

You only go for the 8% interest when you file a claim through the courts. As for the offer you have received it is entirely up to you whether you accept it or not. You can always send a partial acceptance letter and go for the extra 8% at court.

I have used the complex bank charges spreadsheet which you can see part of below, this gives the total penalty charged as £221 and interest on penalties as £256.74

 

(note: I have cut out the spreadsheet as it did not paste)

If the interest on your penalties is that high, it either looks like you are using a very high % rate or you are compounding the interest.

The second figure on each line is the amount of interest that has been charged. and the last figure on each line is the amount relating to the charges.

Hi lhawk. I think there might be a slight formula problem as it looks like you are claiming back all of the interest when you are over your limit. I don't think that is right. I have tried to use one of the spreadsheets here but unfortunately they have gone a bit haywire.

I thought it did seem a bit large but I keyed in the information exactly the same as my other claims, on the same spreadsheet.

 

Would you like me to send you my copy of the spreadsheet if that is of any help?

I have a copy of the advance spreadsheet on my machine and, just like the ones in the template library, it has gone mad. They must have a self destruct time limit on them lol

I have looked at the refusal letters in the FAQ Section, but I am still unsure which letter to send.

 

The letter from the bank says "Full and Final settlement of your complaint" and they will issue a cheque in 14 days.

 

The letter was received After the expiry of the LBA, but before court action

 

From what I understand, letter 5 and 6 are not applicable unless I have started court action. there are no further conditions attached so letter 2 is out. Letter 4 is also out as it is a "Full and Final" offer.

 

So I am not sure if I should use letter 1 or 3... Please help!
