    • Today as the registered keeper of the vehicle photographed, I received a Parking Charge Notice, for a private land car park. I have looked at streetview and I dont think the signs are noticable, they were not placed on entry to the parking area, but on lamposts around the plot. It's not ANPR monitored but must've had someone on foot as they had photo of the vehicle parked in a bay. Is this one worth contesting or will it have to be paid?   1 Date of the infringement 28/5/24   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/6/24   [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 10/6/24   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? It doesnt seem to. It states they operate in accordance with the International Parking Community's Code of Practice (IPC). On the back it says "Contesting this parking Charge" and under this heading it states that "all letters contesting a parking charge are carefully considered and replied to within 28 days. Charges are put on hold until an appeals decision has been reached. If we reject the appeal, you will be provided with the contact details of the Independent Appeals Service."   There are two official bodies, the BPA and the IAS.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, i'm a virgin here so please bare with me :) I'm about to claim back charges from HSBC (I just found out tonight the (edit) ******** charged me over £150 in charges this month alone) and wondered as my wife and I have both joint and single accounts, would the £10 charge cover them all or just for each single account? As we are with three banks I plan on hitting them all for the money they've (edit) off us over the years. Also, should I claim back further than 6 years or just for the 6 years?

Think the above post will be edited - please don't use potentially libelous terms. I know it is an emotive subject but you will get much better rfesults if you stay calm. You will also find that you get much better response if you post your thread in the HSBC forum

As I understand it, the £10 charge would be per account although HSBC in a lot of cases have waived this.

If it was me I would send of a request for each of the individual account

£10.00 however They won't cash the £10. As they are obliged to send you the statements without charging you, I would say you will get a letter soon with the Original cheque. With a Copy of your statements as requested will be posted to you in the next few weeks after that.

 

 

in the mean time Just keep looking at the postings they will give you a feel for timescales etc just look at the dates of the individual threads.

 

 

It may fell a little slow to start waiting for statements, once you get them the pace pick us as you are in control not them

 

 

 

If it's any consolation the £450 in charges in 6 week that made my eyes water when I went through my statements.

 

 

 

If you do it step by step using the Guides then you do just fine..icon12.gif

As I recall, they CAN charge for providing those statements under the DPA, they just choose, for whatever reason, not to in a lot of cases.

 

Oyster, that £450 would make my eyes water as well...well harsh tbh

TBH, I think a lot of peeps will be surprised when they got through the statements as to what they get charged if they are / were like me head in sand motiv - Not any more got it sorted now.:-)

Yeah I was a bit like that as well until someone mentioned it on the school run one morning.

 

MS Excel is great for working stuff out as well as you go along through the statements, although I wish I'd used the one on here now.

we've all been at that stage of 'despair'!! then we get the idea placed in our heads from 'whatever' source to get even. and bwoy what a feeling when that cheque/credit in the a/c comes your way - we win... simple as that!!

 

key is... do your homework so you understand what you're doing, don't be impatient - after all, you are claiming for money that you thought you'd never see again, and ask as many dumb questions as you see fit!! better to have asked the question than to try and correct a mistake after the event.

Appologies for getting emotional everyone, it just really :-x me off you know. I had a bad patch last April where I was diagnosed with chronic prostitus and had to give up a very well paid job (well, very well paid to me anyway) and I have been stung something terrible with charges on both my bank accounts and also my credit cards. Can I also get back the charges for my credit cards?
