      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

And thanks for such a helpful site, misy say I didn't know anything about claiming back my charges until my wife read about it in love it magazine and brought it to my attention.

 

Just spent the day going through my bank statements what I could Find, Missing 2001 - 2003 but already found £1603 in charges, just used the the letter template to ask for the statement so I can work the full ammount out.

 

So once again thank you for such a helpful site and I look forward to posting my progress on here in the near future.

Strange coincidence just recieved an automated telephone call telling me I had a customer services message and to ring back on a 0800 number, So I rang back to find out what it was, And got a message from a company called action 4 consumers offering to reclaim my bank chargesfor the last six years for me.

No, from what I understand they take 25% of what they claim back for themselves and no point paying someone to do something I can do myself with teh help of this website/forum.

A quick question and I hope someone can help, If the case goes as far as getting a court date do you have to attend in person, it's just that I have an illness that might stop me from attending.

 

I thought better to ask at eh start than when it's to late.

But if I do mention it will lloyds find out, my biggest worry is that they may use it to there advantage if you know what I mean

I posted my data protection act request letter on the 2nd april by recorded delivery but the royal mail website is not showing it as delivered, What do I do?

I wouldn't rely on the RM website, it's pretty dodgy sometimes. It's early days yet really, but if you haven't got your statements in a couple of weeks, come back on here and let us know.

Hi All

Thanks for all the replies,

Well I got my list of charges back today but only going back as far as September 2001.

On top of that they missed a sheet of charges out between 01/05/2003 and 01/10/2003 and it would have shown £390 in charges, thank god for the internet I found it while cross referencing with my on line statements.

So there’s a warning check, check again and double check

Just had a reply to my Preliminary approach for repayment letter can I know send the Letter before acction or do I still have to wait the 14 days?

when I do send it do I put the refrence number I've been given on the reply????

Hi All,

 

In need of some advice, due to been ill. I haven't yet took them to court and I've had no reply to the letter before action I sent on 29/05/07 as I have missed the deadline I gave them can I just continue and issue court paper or do I have to give them a new letter before action with two weeks notice.
