Hi all

 

I sent my SAR letter recorded delivery to natwest on the 14th March enclosed with a £10 cheque. Today i received a letter through the post stating they are not sending my statements out as my request did not have all the information required. they stated the following was missing

  • The fee is £5.00 which covers all accounsts requested. ( A lie as 10 was enclosed)
  • We have a different address on records ( Another lie as they have been sending me letters to my address for past 12 mths and recently requesting a pay my overdraft)

I just cant believe that they would try this low tactic, which is simply to try and put me off and delay my appeal.

 

My next letter will be containing all this information but i still think the 28days should be from the initial letter as they cannot get away with excuses like that.

Hi and welcome to the site.

 

You've definately taken the first step into claiming back what's rightfully yours, although you have unfortunately hit a snag so early on in your claim.

Did you use the standard SAR template from this site? If so, I agree that your next letter should meerly point out that your initial letter had £10 fee enclosed and that they have been using your current address to communicate with you sufficiently up until now. It might be worth adding to the DPA heading the you are requesting a 'Full Formal Request for Information' which is what I had to do with Halifax as they deemed the initial letter sent (from the templates section which has been tried and tested 1000s of times) was no good.

I did use the standard letter and displayed the DPA subject access request in bold on the top of my letter - unmissable! I did read all the literature on this site before i sent the letter, but reading back a few users have posted that they only charge £5 but still, they could cashed the cheque and simply took £5. I have just filled the information they have requested that was missing! I have told them i am unhappy with the response and class the deadline from the 1st letter not this new letter.

 

Good luck with Halifax, i got my statements off them within 5 days and they didnt charge me. Just sent my prelim off 2 them now, they have been on their best behaviour so far!

You lucky devil you, i've had a nightmare with halifax and I'm only just about to send off my PRELIM!!!!!! Yep, and they charged me:rolleyes:

 

I had all the information needed to start my claim with Natwest without having to do the SAR part, gosh does it make things that bit easier!!!!

 

You seem to have everything pretty much wrapped up, any probs or if you simply need to clarify some points then do not hesitate to ask.

Will do. i was startin to fink my message was a bit over the top with the title "natwest ****" it was a bit, but they bring the worst out of me. I Just read their letter today and i thought how pathetic.

 

I think il have to go all the way with both claims, im sure halifax will not continue to be so obliging!

hi willo

 

you will get use to delaying tactics it took me nearly 2 months b4 i started court proceedings as i hand delivered my LBA to my local branch i followed that up with aphone call to confirm it was being forwarded to the correct department.I was told it will be sent through there internal mail system and to ring again in 2-4 weeks.i rang them after the 14 days (from the LBA) and was told they coulnt find any letters from me,a week later they said did i have any proof i had dropped a letter to my local branch.Obviously i didn't so i started from scratch again,so dont be surprised if they lose items etc make sure you send all correspondence recorded delivery so you have proof that they have recieved documents. Incidently cobbetts still said that 1 doc i sent them wasnt in the envelope ,so i now send all docs etc by post and fax then ring and check that they have recieved the fax and letters..
