    • If you're set on pursuing the receiver then a complaint to his governing body (if any) might be a sensible low risk first step. You need to confirm what qualifications he actually has. I don't believe an LPA Receiver necessarily needs to be a licensed insolvency practioner, although he may be. Or he may a chartered surveyor. I note you say "LPA" and "fixed charge" receiver, but aren't those two different appointments with different remits? What relevant powers are given in the mortgage terms and security? Or if that's unclear then how was the appointment described to you? Ducking back to the comment I made earlier, you consulted a solicitor who advised a claim against the receiver. How did he advise that you do so?   Some background reading (accepting it's from 2013 and you may be working off more recent preceded overturning this) ..       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well i have recieved some of statements relating to my three claims with capital one. only about 8 months of two of the accounts so far, so hopefully postman pat will be delivering the rest tomorrow.

 

The funny thing was that they sent every statement in a seperate envelope. what an absolute waste of paper. if they deliver them all together i will have about 100 envelopes... poor postie

we have 3 claims in total with capital one, so i am hoping it will be enough to pay off what i owe, i have paid off two of the cards so i just want to pay off the last one. not used the card for some time because i was fed up with all the charges

can some one help me with contractual interest please with my cap one account, is there a specific template that i can use to work out the interest. i see there is one for the 8% but how do i work out one using the interest rate for capital one which i presume is about 29.94

Hi Cheesenpickle,

 

I had the same trouble myself, but I just changed the 8% spreadsheet to the specific rate and used that. 1% is 2.75 hence 8% being 0.00022. Your 29.9 is approx 0.00082. I just clicked on the first cell in the column and changed the 22 in the formula to whatever I needed and copied and pasted it to the rest of the column. Someone correct me if I am wrong - but I checked my figures with an on line interest calculator, and they added up.

can i get some confirmation that my details are correct, should i change the interest to o.00082 on the formula then? and am i doing right claiming contractual interest , do they tend to pay out on this? sry to be a pain i just want to be sure and do not want to make mistakes

That is what I did. I charged cap one the rate they charged me. It remains to be seen weather they pay up or not, but my guess would be they will!! The alternative for them is to go to court, don't think they want to do that. Even if they did, the most the judge would do if your rate wasn't agreed would be to change it for the statutory 8%. I will be filing at court soon with my contractural interest.

I Am Doing Two Claims For Cap One , One For Hubbyand One For Me. All The Way Through I Have Had No Offer For My Account So I Filed For Court. But For Hubbys They Offered 100 Pound. Cant Understand How I Claimed The Same Way On Both And Got Offer On One And Not On The Other.... Weird

well i have recieved an offer on one of my cap one cards for my claim, but not other card, strange as they are all on the same claim, so maybe they are dealing with them seperatly even though i am claiming them together. i have send rejection letter for what they offered as i have already filed for court and it was issued on the 30th april. so they have until 14th to reply or i can apply for judgement.

It basically just gives them another 14 days to issue defence, you are well on your way, just a matter of time now. So basically they get 14 days from date of service, then if they file an acknowledgement of service they get another 14 days, so 28 days in total.
