    • Did the Claimant's WS not have an address on it? If they're doing no witness attendance and their WX doesn't have address pers i'd be asking judge to not allow it under CPR r3.4 2(c) based on the Defendant's failure to adhere with the N157 directional notice which shows clear disregard for CPR. Evri's been caught out for non cpr compliance so worth a shot in any case imo
    • Once social services become involved, it is very difficult for them not to attend a property.  If someone died and later there was an inquest, social services would be under a spotlight about actions they failed to take, that might have prevented the death. This is the reason for the legal department sending the letter. Not saying that anyone in your household is in danger,  but social services without visiting may be worried about the condition of the housing and possible risk to occupants. I would suggest that you agree for social services to attend, just so that any concerns raised can be cleared up.

    • Its to confirm, or not, if there are any safeguarding issues. These people, as you unfortunately call them, are only there to help, as you and your family are too close to any issues to be objective. Accept the offer, you might not get another chance. H

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well a quick update to anyone who is at the same stage, I have now received the defence from Abbey and seems pretty straightforward, in other words is exactly the same as everyone has been receiving, feel that I am getting near the homeward straight now....

well yes you are, if the court issue an AQ use the Abuse Order as part of your AQ

OMG came on to the site today to find the chat forum gone, read the details and am now in a complete mess, recieved my AQ today and am not sure what to fill in at H (other information), whether to include the draft order as stated in Bank fodders recommendations and whether to include the abbey abuse order, the information in the draft etc etc, please help someone.....getting nervous

Hi African, not sure what question I am answering but Abbey have decided to defend (what a surprise), today, having phoned the court to inform them of an impending holiday I recieved my AQ (allocation Questionnaire) I spent the whole day filling it out and decided to add the abuse order for a little bit of extra pressure....I will phone Abbey in a few days and ask them to settle, not holding out much hope. The N1 form was easy to download and fill out, but as my claim was over 5K it cost £250....today I had to send a further £100 to lodge the AQ, hope this helps, but watch the thread if you are nearly at the same stage and we can keep each other updated.

Hi - Thanks for the update I didn't digest that yours is over the 5k threshold mine is @ £4,300 inc of 8% s.69 But rising. I will check the threads for N1 route under £5k small claims court as I got the details for MCOL.

A very sad update on Monday this week my partner died and under the circumstances when I recieved Abbeys AQ I decided to contact them and try to negotiate a settlement the task ahead being too much to bear, they were very good and settled with me just £300 less than my claim, they have processed my claim on a fast track and now I can put it behind me and grieve for the very special person I have lost

Hi Dozer! So sorry to hear about your loss. It is a difficult time for you and no words can now express the way how you are feeling. I have been there when my brother died last year. All I can say is try to stay strong (I know that it is difficult), and just a little note " Memories are good however, they can sometimes ruin your soul" Stay occupied with other things. May your partner's soul R.I.P. I wish I could be there to give you some support.
