Preliminary Letter sent 22nd January 2007

Negative reply received 31st January 2007

LBA sent 12th February 2007 by registered post, no reply received.

Form N1 Claim Form completed on line 1st March after receiving £30 bank charge for being £4.32 overdrawn. The claim was issued on 2nd March 2007 by the Northampton County Court.

Received the Acknowledgement of Service which was completed by Lloyds TSB Solicitors. They are defending all of the claim of £1,284 + interest @ 8%. What happens next?????

Stick to your guns and follow the directions from the court .Apparently this is normal and standard from lloylds .However they always pay up at the last minute!!!!!! you should receive an AQ soon . Complete using the guidance notes from this site.

Ohh read , read and read more ..... To be honest i spend hours reading through every thing on here . Im not at the same stage as you however i feel very confident that i know the procedure and what i need to do .

You will get an AQ from the court to complete - all perfectly normal and typical of Lloyds.

Please note that I am not a legal expert and all advice given is without prejudice and is purely my opinion only.

** Halifax Mortgage -£390 - PAID IN FULL - Nov 06 **

Lloyds TSB - MCOL issued 09/03/07 - £2953 + costs - ON HOLD....

Received offer letter from SCM 4th April, returned to them accepting offer but without conditions. After some delay they paid the money into my account on 30th April. Sent letter to court stating that proceedings were finished.

 

Received another letter from SCM yesterday, stating that since I had not had the courtesy to reply to their letter of the 4th April they were advising their client to pay my claim within 7 working days. Lo and behold today I have checked the account and yes they have paid in the same amount as they did on 30th April. What do I do now, and can I legally keep the second payment.

lmao ..... I wouldnt like to advice on this .... its a difficult one .... Hopefully someone else will come along soon and advise

Brilliant, they really are useless! I had a customer phone them the morning of their court case to see if they were going to settle, the guy wouldn't even go and check, he just said that if he hadn't had a letter they must be defending. We went to court and won. 2 days later the client received a letter offering settlement dated 10 days prior!

 

The problem is, these people are used to chasing debts, not paying them and they behave accordingly.
