Hey tractordriver - if this if for the full amount of charges minus court's 8% interest - you really should accept!!! If you was going for CI............over to somebody else!!!!!!!! xx :D

Hi Advoc8

I used the simple exel on the CAG for my prelim and my LBA, but didn't show the "interest" or the "days since" column on the excels. I did state in my letters how much interest I was wanting back. I think this is the 8% one isn't it.

Have I Boobed?

Yes, this is the 8% statutory interest.

 

Have you boobed? No, I wouldn't say so. That interest is only awarded at the discretion of the court so you're not entitled to claim it before you file a court claim.

 

If you'd wanted to claim interest on any other basis that would have needed to be done from the start and is often complex to work out properly, and may not always amount to much anyway.

 

In this case you've really got no option to accept the full refund.

So I sign on the dotted line and accept their offer!

 

It wasn't difficult to get a result. But it was all down to the encouragement and skill of the members on CAG.

Can a finance company have a "Flat Rate" charge for a returned Direct Debit and continually tell me this is what will be or do I have the same bargaining power as with banks in that their charges should reflect the cost of the service, and not be seen to be profiteering.

Yep, sign on the line, but don't accept terms you're not happy with (like confidentiality, for example).

 

The same principle applies to the returned direct debit charge you mention - it's a penalty for your breach of contract, so you can start to investigate that one now.
