I don't remember - but again a copy of a letter has been provided (see bundle on previous thread)   Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ?  No    Why did you cease payments?  2015   What was the date of your last payment? December 2015   Was there a dispute with the original creditor that remains unresolved?  I wrote to Barclaycard back in 2015 to ask them to send proof of the original agreement but they just sent me a reconstituted document which had no personal deals on relating to me   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? yes - step change took control and set up payments of £1 pm
    • I have had no such luck getting the tickets cancelled. So more help would be greatly appreciated. I have debt recovery letters now. I guess I ignore these and only respond when there is court proceedings?
    • On MCOL there are 2 times the case stay is lifted. Once between filing the defence and them submitting a DQ, and then again between them submitting the DQ and the court issuing one to the defendant.   Is that normal or is there anything I should be aware of?   Thanks as always 
    • It's difficult to advise what to do because there are so many ifs and buts. In the majority of cases where a PPC start a court claim they go all the way to the final hearing. However, in a minority of cases, and by no means a tiny minority, they have no real intention of going all the way to a final hearing. They know their case is rubbish and they know it will cost them a hefty wad to send a solicitor to court (remember solicitors' costs are capped at £50 at small claims).  They pretend they are going all the way to court to intimidate the motorist into giving in.  Yes, the pretence often includes paying the hearing fee.  Yes, UKPC often do this.  And no, they haven't produced a WS (so far). I suppose it depends on how much you have spent on flights (and accommodation?) and if this is refundable v the approx £250 at stake if you lose the case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Where is your hearing? manchester anywhere. Dont know about you? But i am frigtened Getting every thing together is going to be a nightmare.Specially when you dont know what your doing.

I am at Chester - at least we have a bit of time to get it all together. Have you looked at the Got a Court date thread on this site as it seems to go through everything step by step. I am sure it will all go ok, just use the time to understand what you can and prepare - but from all the other results nobody seems to have got as far as court. Are you at the court in Manchester...:)

Hi maggie, dont think we need copies of the N1 or the AQ I hope not as I dont have copies either, sure someone will tell us. I think we just need the basic court bundle and any more info to use as evidence such as the OFT report and the parliament early day motion. I think it can all be found on the GOT a COURT DATE page. We can only prepare as best we can and keep fingers crossed. Sure it will all be worth it in the end ££££.

My court date is 15 august.I havent heard a thing from yorkshire bank.Whats going on? I havent done my bundle yet.But i notice something to do with litigation!Whats this all about? Not to sure.:???:

I am flapping now its so close to court date 15 august.i aint got a clue what to do about this court bundle.My head is up my backside.Worring about this court date.I need to sort this out before its to late.Can anyone point me in the right direction for a court bundle.Which is simple.For a simple person.Please! please!:???:

No not heard a dickiebird but don't really expect to till the very last minute or even on the steps of the court!! Just about sorted the bundle out and hope to send that off this weekend probably cost a fortune to post. Keep your chin up nearly there all the hard work has been done - at times it has been a bit daunting but the folk here have been fantastic;) ..

What do i do about the interest thats accrue at 49p per day untill settlement.Do i leave this untill the day of the court?Or add this on?Not to sure how much this is? Since 23/04/07Are you any good at adding up? Thank you

I am in the middle of getting my court bundle ready.I have printed off the court bundle from this website.I have copied my statements.The letters from them.What else do i need?How do i present the file for courts. My court dates 15 august.I want to make sure i have everything right so i dont mess up.Havent heard from yorkshire bank yet.Not a thing.Please put me on the right road.Whats a litigation?Ihave seen this wrote up around the site.

Maggie May, I have just recieved my hearing date yesterday for 25 Sept 07, Only they have given me until 1 Aug for them to receive my court bundle, a whole 6 days, that is kind of them. Anyway I am panicing a little like you. I have also printed the court bundle but am yet to read it. We both need to get hold of T&C's for Clydesdal/Yorkshire Bank. There is a library link on this site, that is under construction, which has a limited array of PDF copies of T&C's I will download the software that allowes me to read them tonight (Rapidshare or something). Also, not sure if its applicable but there is a link for a report by the OFT against the banks regarding excessive bank charges that may be useful but the one I have found is for credit card charges and I am not 100% sure if it is also applicable to Bank Charges. Let me know how things progress and if there is anything I can forward to you.

Hi maggie just been on channel 4 news that all claims maybe suspended due to the OFT takinig the banks to court - so we may have to await the out come of that hearing. Can anybody shed any further light on the matter..:confused:

I have emailed the OFT and HM Courts Service to find out the current impact on consumers awaiting the arrival of their hearings. I would recommend that you all compile your court bundles regardless, there is no harm in awaiting today's judgement before popping them in the post. Fingers crossed that for once the consumer will reign triumphant. Monitor OFT website and all news agencies closely today.

"Zootscoot" a Moderator of the Cag Site has posted a piece on the site for everyones viewing regarding the "Court Case" test , and has said that anybody that has already issued a claim to continue as normal unless you hear otherwise from court, also make sure you comply with any orders and to attend all hearings, but to be prepared in case the Courts issue a Stay pending the outcome in the High Court, which could be a lengthy process.

If you have not issued a claim yet then still stick to a timetable as before and issue your claim, as if you leave it until after the High Court Case, you may lose the right to claim some of the older charges under the "Limitations Act".

If your case then happens to be Stayed at least you will have your foot on the ladder.

 

The Test Case if Successful on the substantive issue of fairness will go on to consider issues of limitation and restitution.

Hello caro.I am stressing a bit.,Not to sure what i need.I have downloaded.Bookworms.court bundle for cag.My letters from bank.My letters i sent.Do i send my statements to court or list of charges? Thats all i have really.Not to sure what else to do.Mmy court cases is 15 August so i have to send all my things off to bank/court before wednesday.I have asked a couple of times for help but got no reply.How do i send it off in a folder?
