Hi, I'm currently claiming back my girlfriends charges from lloyds.

I filed a claim via MCOL which was issued on the 26/02/2007.

On the 03/03/07 she recieved a letter from lloyds, dated 27/02/07 which offered her a refund of £490. The amount she is claiming is £652 in charegs, £57.34 in interest and £80 in court fees, total £789.

When i checked her account online i noticed the £490 had been paid into her account. I sent a offer rejection letter stating i started a claim, and to pay the remaining amount or take the money out of the account.

The claim has just been acknowledged so what should I send to the court manager? Lloyds have not responded to my offer rejection nor taken the money out of the account.

Hi

 

When the claim is transferred to your local county court you'll get a "notice of transfer of proceedings" with your allocation questionnaire.

 

I would then write a covering letter to the district judge with your allocation questionnaire explaining this. Don't ammend the claim if they leave the monies in your account. You can't claim back the £35 fee if you do.

Just carry on with your claim, you can sort out the goodwill payment afterwards, Lloyds should pick this up in their defence. It is not usual for these payments to cross with the filing of the claim.

 

In case you are not aware and as you filed using MCOL send 2 copies of your schedule of charges, clearly marked with your claim no. and a brief covering letter asking for them to be filed with your claim to:

Northampton County Court

21-27 St. Katharine's Street

Northampton

NN1 2LH

 

Dear Sir/Madam

 

(Your Name) –v- (Bank)

Claim No: ********

Date Issued: xx/xx/xx

 

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

 

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.

Yours sincerely,

 

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

Please find enclosed a copy of my schedule of charges relating to the above claim.
