    • Hi, I have the Sims 4 on Macbook. Over the last year I have paid for multiple add on packs spending a lot of money on them. I bought them all in good faith as my Mac met all the minimum requirements to play them. I have been playing happily for about a year and bought my latest pack just over a week ago. The games were all working fine yesterday. Then suddenly today EA released a new app to launch the games and this new app requires a MAC OS that my computer cannot use. Now suddenly none of my games are accessible and I am unable to play anything. They did not warn us about this change in requirements and if I had known they would be doing this I wouldn't have bought all these add ons as they are now all totally unusable. The games themselves have not changed, only their app to launch them and I can't afford to buy a brand new mac just to play. So my question is how can they change the minimum requirements after I have paid for a game? I agreed to pay for them based on the fact my mac met their requirements and was not informed when purchasing that this would be an issue in the future. I understand new games (like Sims 5 which is to be released next year) might not be compatible but this is a 10yr old game that they have suddenly made inaccessible due to their new launch app. Does anybody know if I can do anything or anyway to get a partial refund from them?     • OK. Thank you all for the input.  I'll ignore their letters of demand but NEVER ignore a letter of claim. I'm bracing myself for the stress as their demands £££ goes up and the case gets sent to debt collectors. 
    • OK.  It was worth a try. Their case is still pants and they have broken their own Code of Practice numerous times.
    • @BankFodder sorry for the delay and thank you for the lengthy reply. Yes, I agree. It's a small business and the guy is very very decent. I know someone else said my priority shouldn't be worrying whether he gets shafted but I'm not here to try and screw him over because I feel like if someone behaves decently and gets exploited, they might not behave so kindly in the future. I know DX mentioned he thinks I've caused the issue by leaving multiple instructions, but I have already explained why and both instructions were to leave it with a neighbour and there was nothing advising the driver to abandon the parcel on my doorstep. I don't think leaving it there could be considered a safe place.  I am still waiting on the retailer to respond. Ultimately, I wanted to know how he would proceed if DPD's response isn't favourable. I am certainly not looking to cause any problems. I just want my laptop. I will read the other posts for sure. I've been a bit preoccupied with family stuff. I have nothing in writing from DPD as I phoned them, but they did advise it should be the retailer that liaises with them. I tried contacting the driver straight after deliver via Whatsapp, as that's an option, but it said I couldn't send him a message and I have kept that log. We all know who took the parcel on our street, because that person has a history of parcel theft, but I don't have a doorbell camera or cctv. Police are refusing to intervene, despite the fact that I, along with several other people, spotted another's neighbour's parcel in said "suspect's" car and confronted her to get the parcel back. If the police had acted sooner, I might have had a better chance of getting the parcel back, but I suspect the laptop has long been sold on.  When the retailer responds, I will send him the link to this thread. Hopefully, he will benefit from the information on here as well.
    • @dx100uk none of the instructions advised them to leave the parcel on my door step and without such instructions., I'm struggling to see why they think it's ok to just dump it there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi. I think draft directions are something you can ask the court to do (e.g. tell the court actual cost of charges) before you go to court. think this link may help. Good luck

My court orders are that the AQ should be dispensed with, so I have none to complete!

Hi guys, hope all is well, received a letter from the court today including LLoyds defence (standard 9 point as far as i can see) they have also attached a letter saying

 

Notice of Defence that Amount Claimed has been paid

 

The defendant says that the amount you are claiming has been paid (see attached form N9B)

 

Please tell the court what you widh to do by completing the lower jhalf of this form and returning it to the court on or before 6 May. You must send a copy of the completed form to the defendant as well as the court.

 

What is basically says is i had a payment of £750 as a goodwill gesture, i wrote to lloyds saying i would accept the payment as part payment (see prevoius posts) but not in full and final settlement.

 

I can fill in the form saying i wish to proceed with the claim but it does not give me the chance to mention the £750

 

Is this just lloyds trying it on?

spoke to MCOL who said i should send a copy of the bottom part of letter filled in to them and to [problem], so will send that today and hopefully receive the AQ soon, has anyone else had this?

You may or may not get one, lately a lot of Courts seem to be dispensing with the AQ, so it's just a matter of waiting, or give your local Court a ring and ask them.

quick update, my case was transferred to Hitchin Court on 20th April but they have not yet received my file so cannot tell me if i need to complete an AQ...the court is no where near my home address so i have asked for it to be moved (hopefully this wont matter as fingers crossed i wont actually have to go!) will just wait and see what happens with the post, seems to be taking so long though....patience i know :)

If you do not hear in about 2 weeks, phone Hitchin court staff - they are usually helpful.

 

If you end up with an AQ it has a part to request a transfer to your local court that you can complete. Be aware though this is likely to delay matters for a few months.

 

Regarding actually attending Hitchin court, whilst it is unlikely you will get to the main hearing, if there are directions or allocation hearings then you may be required to attend.

thanks for the reply, i think i will stick with Hitchin then if it will delay matters...i can travel there if i have to

 

will sit on my hands and try not to call anyone to hurry them up (i am a bugger for that!) :D

Got in the post yesterday a 'notice of transfer of proceedings' it says:

 

'A defence to this claim has been filed.

The claim has been transferred to the court covering the area where the claimant lives.

Please read the accompanying documents carefully.'

 

Then the following line has been crossed out

 

'note that the allocation questionnaire should be returned to the court'

 

So i guess no AQ needed??

 

Then it says

 

'Without hearing it is ordered that the filing of an AQ be dispensed with in this case unless the DJ at the court of transfer orders otherwise.

 

Then there is a copy of the defence and my documents...

 

So what is next?? It doesnt really tell me what to do??

I am the same - you wait to hear from your local court but don't hold your breath! Ours has a huge backlog - the transfer notice was dated 30th March and we still haven't heard anything.

progres update for you all...

 

Received in post yesterday a 'Notice of allocation or listing hearing'

 

It reads:

District Judge Willers has considered the statements of case and allocation questionnaires submitted in the claim and has decided that a hearing is necessary before a final decision about allocation can be made.

 

District Judge Willers orders you to attend at 13.00 on the 15 June 2007 at Hitchin County Court.

The reason for the hearing is as follows:

1 The issues raised make this case unsuitable for Small claim Track. The court is proposing to allocate to fast track

 

Important Notice:

The hearing of this case will take place by way of a telephone conference. the defendantslegal rep is ordered to arrange the telephone conference.

 

Please note that the DJ has stated that you must pay the allocation fee of £100. Be advised that AQ's have been dispensed with but the case must still be allocated.

 

I think i understand most of it and i have spoken to the court. I am a little unsure of the difference between small and fast track and why mine is different, the court told me it is not to do with the amount of the claim so not sure really.

 

The court advised me to call **** to see if they are thinking of setteling as i would then not have to pay the £100.

 

I havent seen this before, anyone else?

Generally if your claim £5K goes to fast track.

 

Procedurally not must difference, save standard disclosure, fast has it.

 

However, the significant difference is the exposure to legal costs. The party that looses will bear the others sides legal costs.

oh lordy, i cannot afford to pay their legal costs...my claim is for 3k so i am not sure why this has happened...what do you think the chances of **** settling before the hearing?
