    • Hi. Many thanks for your response. You are correct it is Royal Barn Road that is stated on the PCN.  Where i was was Royle Road. I originally came from the Tesco side, was initially parked across the road where there are parking bays, then moved over to side where the double yellows are.  I did check the entire street from Tescos on, and there are no signs for restrictions at all. Also, the friend who owns the house asked the building company sales office today, who also believe the double yellows are old (some of them turn into peoples drives), and said there should be none.  - Obviously if the council have them as current thats besides the point. SO the big question is, given the PCN states very incorrect information, Location, and type of contravention, can it be challenged? Thanks
    • Please see below for the Witness Statement from UKPC received in the post on Friday, 3 May.  The letter is dated 1 May 2024. I am also including Exhibits 1, 2 and 3.   The remaining exhibits relate to the PCN's and other correspondence already posted on this thread.   The most glaring mistake for me is in Exhibit 2 (UKPC's OWN copy of their signage), NOT SHOWING that parking is not allowed between 22:00 and 08:00.  Note that this restriction IS showing on the draft sign approved in the contract between UKPC and their client.   Also, the site plan in Exhibit 1 shows signs against the wall of the building (depicted by a "W"); whereas the picture in my witness statement clearly shows no signs visible on that particular wall.   I look forward to hearing everyone's feedback on this!       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello All,

 

First ever post.

 

Called Lloyds this evening querying £90 Overdraft "Fee" and was told that it was a charge because "I was using Lloyds money not my own."

 

That's it - I've had it ......... DPA letter in post tomorrow morning for all 5 of my accounts (plus hand deliver copy to Branch) - the ball is rolling.

 

I've lurked this site before but had convinced myself that if I managed my finances better that I wouldn't get these charges.

 

Wish me luck ....... I'm sure you'll see more of me

Hello All,

 

Received my Data Information today - 2 anonymous envelopes marked Private & Confidential - 2nd Class post.

 

My original letter was posted on 20th May 06.

My payment cheques has Not been cashed.

 

So not a bad turnaround I suppose.

 

They have included a set of front sheets that shows all "charges" & "fees" , an explanation of all abreviations and copies of my statements - for the accounts as requested.

 

Also they identified 2 sheets missing from 2000, with a promise to forward asap.

 

A very quick tot up for both of these accounts of all the items that say O/Draft Excess Fee or Returned S/O Fee gives a total of

 

£952.00

 

 

I will do an in depth review tonight and see if this is all.

 

 

The next step is completing the Spreadsheet.

 

 

Would be interested to read other posts or replies from someone who has already done this .......

Thats what I thought but read this :

Surely not ? - £315.00 CHARGE ????????? Never.

 

 

Just looked at that particular sheet online - and nearly fell off my seat. There it is in Black and white........

 

On that day LLOYDS TSB removed from my account, charges totalling : £411

 

I cannot believe it ....... WTF are they doing ?

 

Or am I missing something here ......

Are you sure the £315 is not the amount of the DD that bounced? If you look in the debits column next to this charge it should tell you how much was actually taken.

Checked the Debit Column on the Statement

 

went from approx 1300DR to approx 1700DR so it was definitely taken out of the account, along with interest charge and OD Excess Fee..

 

It is so large a figure it must be the value of the Direct Debit musn't it ?

 

But why would it have CHG (Charge) in the Type column.

 

All my other Direct Debits have DD in the column plus the name of the Account.

 

I've checked a few sheets back from this & it must have been a particularily bad time because I had upwards of £1200 in bounced Direct Debits - about a months worth - could this be a charge for them - there were at least 9 of them - that would appear to be £35 each.

 

It must be a charge - theres only a few like this in the list.

Right then,

 

been through all of my DPA info and transferred all the charges to the Spread sheet.

 

Total is £1,641 plus interest of £139.24

 

 

About to draft my preliminary request letter. Do I include the interest at this stage - all of these charges have been applied whilst I was in Overdraft - I'm always in Overdraft (LOL).

Hello Folks,

 

Another quick question(s)

 

I've read in various posts about "Defaults" but I don't really understand what that means. Can anyone explain please ?

 

I've just handed in my Prelim letter to Customer Care at 125 Colmore Row in Brum (This isn't the Colmore Row Branch BTW)

 

& I have taken out the bit about Defaults in the letter - I haven't had any - I think.

 

So whats the next step ? Waiting for the standard "bugger off peasant" letter then an LBA I presume.

 

I haven't as yet set up my parachute account - I gotta do that quick I suppose - but all the banks I've raised the question with want previous statements, firstly these make pretty poor reading due to redundancy, now self employed and 2 kids arriving, and secondly I dont receive paper statements anymore since using online banking.

 

Any recommendations for a quick turnaround ?

in the mean time it is worth getting all gen'd up with the county court practices, buy the book that is being advertised on here INVALUABLE!

hey sequenci

 

got my self a little confused - I'll try to explain.

 

DPA request was for 2 accounts.

 

I put together my original letter and added all the items together for a total - unfortunately I headed my letter with just my primary account No. (Not both of them)

 

Now I have used Vampiress Spreadsheet to work out the interest (using the before court sheet) on each unlawful charge for both accounts.

 

I now have a new total for both accounts.

 

This new total is £2075 which includes the interest on each charge - this is about £400 HIGHER than my prelim letter amount.

 

2 Questions :

 

When I do my LBA it will be for both accounts jointly - any problem here being as I only mentioned my primary account on the prelim ?

 

My Prelim letter did not include any interest whatso ever - ok to include for LBA ?

Personally I regard my LBA as a final demand, calculated for everything owed to me - the prelim letter was a shot across the bows - if they had settled at that I would have been chuffed.

 

What do you think ? Carry on regardless or resend prelim ?

Hello All,

 

Received today (20th Sept 06) a letter from Sechiari Clark & Mitchell with lloyds Allocation Questionaire attached.

 

2 points they have asked for a acknowledgement of safe receipt and also that I forward a copy of MY Court Allocation Questionaire.

 

Firstly, I assume it is OK to acknowledge the receipt of the AQ and secondly I cannot forward my copy of the AQ as it's already been returned to the Birmingham Courts. (foolishly I sent the ORIGINAL back and didn't keep a copy)

 

On THEIR AQ - i've noticed a couple of things - they have ticked the box for "Settlement" to be postponed for a month to attempt resolution !

also they have ticked the box for an additional witness.

 

What do I do now - acknowledge safe receipt and wait ?

i too wondered about the witness and month to reslove stuff but read on here to just sit and wait...

i did ring to acknowledge but they didnt seem interested!

Hello All, received this a couple of weeks ago - don't really know what to do now .......

 

 

DISTRICT JUDGE DAVIES orders that this claim is stayed until 22 November 2006 to enable the parties to attempt settlement.

On or before 06 December 2006, one of the following steps must be taken:

either

the claimant must notify the court that the whole of the claim has been settled; (see note (i) below)

or

the claimant or defendant must write to the court requesting an extension of the stay period, explaining the

steps being taken towards settlement and identifying any mediator, expert, or other person helping with the

process. The letter should confirm the agreement of all the other parties, (see note (ii) below)

or

all the parties must file a completed allocation questionnaire at the court. Where a settlement of some of the

issues in dispute has been reached, a list of those issues should be attached to the completed questionnaire.

The list must be agreed with the other parties and must indicate that it has been agreed.

Date 25 October 2006

Note (i): Where settlement of the claim is achieved before the end of the period of stay, the following will be taken to include an application for the stay to be lifted:

(a) an application for a consent order to give effect to the settlement

(b) an application for approval of a settlement where one or more of the parties is a person under a disability: and

© the filing of a notice of acceptance of monies paid into court, or an application to accept monies paid into court out of time. Note (ii): Extensions to the period of stay will generally be no more than 1 month
