      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, just a quickie to let you know i have just posted off standard letter asking for statements/charge details and praying i don't have to wait the 40 days, i expecting this to be a very big claim as i got in a mess through selfemployment etc and halifax didnt put a overdraft on my account (which i am now glad about) so lots of directdebits were been missed resulting in charges for even £1.50 short!!! anyway this lead to a spiral effect never getting out of it,i worked out just from 1 years statements that i could get online at £3.450!!! and i bet the other years are not far off! i bet it is going to be around £20,000 and i am very nervous that i will be the one they make the example out of!! i also wanted to ask someone if they know can i claim such a large amount through the moneyclaim website as i thought in a small claims court it could only be claims up to £5000?? please help its already worrying me to death!!

Hi and thank you for that reply,if it had to go to court what would that mean? it wouldn't be able to go through small court would it because of the size?

Hi Miz,

 

The bottom line is that they would still have to prove that the charges were lawful and a true representation of costs incurred by themselves in returning a DD or cheque. If a judge rules that they were unlawful then every single customer will want refunds and that would just be too costly for them.

There are some threads on here where people have claimed for this kind of figure, don't know which ones so you'll just have to have a dig about, you'll see what they did.

Hi all just a update got my statements got near the 40 days and decided to ring them and was told i sent the letter to the wrong address (i sent it to the card one in dunfermline) instead of the trinity road one, but a few days later they all came anyway totalled it up to £11,179 :eek: not as bad as i originally thought but bad enough, sent my letter along with list of all the charges,they got that friday and this morning (24th april) got the standard letter saying they are sorry to hear about my complaint blabla and they have 8 weeks to investigate it acording to the fsa! is this right and have i to still stick to the 14 days? the send the second letter?:???: thanks in advance :D

Thank you for replying, thought it was standard letter but thopught i had better check, nice to know there is someone else out there with similar size claim too tilly, counting down the days, should the next letter be same as second letter or just a court action one?:???:

hi miz-print had a shock today done my interest sheets added up to quite a tidy sum thought id do them out of the just in case i need them think i might now looking at the amount bumped it up another three grand

Hi Tilly49 any news yet? i myself did the interst too which puts my claim should i have to issue court proceedings at ;£13,486! i didnt realise it would put quiet so much on, poor halifax what a shame :lol:

hi miz-print sent lba of today my interest brings mine up to £15.000 good a my heart bleeds for them not printed out all my interest ready to go if need be got a feeling i will have to file court papers but ha ho if it gets my charges back needs must they want a fight they can have one:lol:

hi miz-print just thought keep you up to date i rang halifax on wednesday nightmare trying to get through but spoke to a nice guy told me they were dealing with my claim should hear by wednesday 9th may funny though lba ends on the 10th looks like court is looming let me no how you get on

Hi tilly, i was thinking of ringing myself too i sent lba this friday 4th may might try with the phonecall next week, i wish they would sort something out though rather than the court thing, are you going to use moneyclaim? it sounds so complicated dosnt it? let me know:-| keep me posted and i will you too

Not a peep from anyone as yet halifax will have got my nice letter though only on friday so suppose got to give them time :| but reading up on court stuff just incase :oops: you would think by now they know how its going to end so why not just get on with paying up! :D

hi miz no the feeling they only until thursday to teply to my lba file court papers on friday decided to do the n1 in the end seemed easier let us no wot one you decide to do and if you get a reply from the dark side

Of course i will let you know if i should hear anything tilly hope you do! i was shocked that it is going to cost you £400 though to file the claim that is alot :eek: is it as much via mcol? wish i was brainier then it all might seem like a doddle its this court thing im not scared just hate forms and im scared to death of getting it wrong :-(

i also panicked when i started with the court papers but there are a lot of peeps here that will help you i found that out they are great i wrote mine out before printing just in case .forms are not my best subject either and i think the fees are the same for mcol it was the interest that bumped my fee up yours should be a bit less im applying for exemption of fees fingers crossed
