Mine is a claim against a closed account...does it make a difference and if so what? i take it they wait until the 40 days are up to send statements too eh..ah well like I said...I can wait...soon be the summer hols
  3. I phoned my branch and was advised by a seemingly nice lady that because my account is a closed one that I should send my request to a freepost address in Boreham wood. Anyway it was deemed as being delivered on the 7th June. Guess it's a waiting game now....did a previous claim against the halifax which went smoothly....what are Nat West like ?

  5. Well FINALLY the Halifax have coughed up....FULL AMOUNT went into my account today....thank goodness that's over. Thankyou everyone for all your support and guidance. Can I ask.....which part of the notice of issue do i fill in and send back to the court?

  9. I second those sentiments abot SSL Lewhay Halifax have until the 7th June to file a defence against my claim....hopefully my money will be in my account before then....I had hoped to go car shopping this half term break ...but I can wait until the 6 weeks holiday I guess.
  10. The date by which the halifax have to acknowledge will be on there.

You will receive your notice of service from the court which basically says the claim has deemed to be served and it will also give you a date by which the halifax have to enter an acknowledgement. They did this to me 3 days before my 14 days were due to expire . Possible outcomes are they will declare they intend to defend or admit liabilty and pay up or simply do nothing. They have told me that they intend to defend and they have until the 7th june to file a defence...or pay up. They usually put the money into your account and then inform you. If they ignore your calim then you can file for judgement against them after the initial 14 days is up, some choose to writ e to them giving them 7 days in which to pay up ( usually followed by payment into your account).
  12. He should file his claim. Is it possible he may be exempt from paying or possibly borrow the money as he can reclaim that back too.

  15. I somehow don't think you'll be alone moneyhelp...the sooner tomorrow is out of the way, the easier it will be for a lot of people

  17. Lewhay33 Halifax have sent myself an intention to defend, they have until a week on thursday to file their defence...i can't see them doing it myself so i expect some money in my account shortly.
