I emailed both Andrzej.Tuleja and James_Goldsmith at Whirlpool dot com. I got a phone call from their executive team a couple of days later, and a replacement part dropped on the mat a week after. She was quite apologetic, however, also reiterated the "90 day warranty" period on customer fitted parts, and did not comment when I mentioned that the CRA also applies as I was a consumer buying from them directly. So I now have a spare door switch if the machine decides to eat another in the future! Cheers all!   Note dx100 that the "Hotpoint CEO" you linked to is not related to the hotpoint appliances, but some kind of marketing app.

It seems that DVLA think that S.88 does apply for applications disclosing a new medical condition after all. Why might this be so, and what of “qualifying application" and "relevant disability"? S. 92(1) imposes on the driver a requirement to disclose a relevant disability. S.92(3) requires the Secretary of State to refuse such an application disclosing a relevant disability ….. EXCEPT S.92(4) requires the Secretary of State to grant such an application if the relevant disability is “adequately controlled”. Hence my belief S.88 can apply for medical conditions (if the driver meets the medical standard of fitness to drive) as the application remains a qualifying application IF the driver meets the medical standard of fitness to drive, until DVLA (on behalf of the Secretary of State) say it doesn’t, provided the driver believes they meet the (medical) standard. Additionally, at (or before) June 2013 (as noted in my previous post) the medical standard for fitness to drive for conditions involving excessive daytime sleepiness was changed from “completely controlled” to "adequately controlled".

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had an account limited by paypal as they " believe " I have been selling adult dvd's and as such this contravenes their regulations, however, because of this limitation they have frozen my money for 6 months after which they will return the money to me albeit without interest. Does anybody know whether this is legal?

Having looked through their user agreement, it would seem that their policy is that funds related to the sales concerned can be frozen for up to 180 days. It is also correct that pornographic material is included in the prohibited items.

 

Now, having said that, could that be classed to be an unfair contract term? On the face of it, doubtful, since it is only enacted where their has been a breach of other user conditions.

 

The only possible challenge would be if you can claim that you had not breached the rules - and that is something only you can answer.

Paypal can and do do as they like. I had £700 of payments I had made frozen for no other reason than 3 of us living in the same house all had our own paypal accounts. It took me about a month of faxing information, including credit card statements, bank statements, the lot, to get it back. This was over xmas and I had to pay the £700 out again to sellers who wanted their money. I don't know who regulates them but it appears they can do whatever they like with your money and they are answerable to no-one.

 

They make a fortune in fees and then a fortune again in interest by taking around 5 days to transfer YOUR money to your bank account. This proves they are ripping us off - Betfair (the betting exchange site) now take paypal deposits. I transfer money instantly from my paypal account into Betfair, then transfer the money from Betfair to my bank account. This transfer usually takes 1 working day, 2 at the maximum. Yet paypal take 5 days, sometimes more.

I too had my account frozen because of suspicious dealings.

All i was doing were selling a few phones on ebay, and they froze my account. I had to send details of my transactions, reciepts, id, the lot.

makes you wonder though, if they can just freeze your acount when they please, then how easy is it to clown your details, ie bank details, passorts etc

and then if you dont come t scratch with them, can they just keep your money? Surely not?

And I have tried tried to contact them and ive not spoken to a humanvoice, its always answering machines which then hang up

 

For one id like to know if they can keep doing this and if there is another way i can do online oney without paypal.

I tried the betfair idea and its true, the moneys in your bank a lot quicker!

They hold your money for 6 months then either send you a cheque or a bacs credit.

They have roughly £600.00 of mine which should come in handy for Christmas.

Nochex seem to be good but on ebay people have been brainwashed into using paypal.

I don't know about these days but when NOChex first started it could only accept payments from UK buyers, which was no use for those sellers, like me, who have a lot of buyers in the USA.

In the UK it is the FSA.

 

Then people need to start complaining, as Paypal seem to be a law unto themselves and are doing what they like with people's hard earned money!

Yes, this is a common problem with Paypal and has happened to me as well.

 

I used to have a web addy for a complaints site similar to the CAG but purely dedicated to Paypal and their shenanigans.

Hi I think the site your refering to is www.paypalsucks.com some very interesting reading

I use Paypal for Ebay and 3 websites and in 3 years have had only 6 transactions reversed 5 overseas (NO POD) and one fraudulent card

I have also found that unlike banks you can get to talk to the organ grinder

when the need arises unless you get there India Call centre in which case I hang up and redail later

I have also recieving 2 sums total £189.00 returned by paypal as goods did not arrive

 

With regards to rip off charges I have found that Im better off with Paypal than paying Merchant Services £25.00 MTH +2.1% as well as GAteway £26.00 MTH

 

Again I think its down to choice Nochex or Paypal

We made a simple request to Paypal for a transfer of £40 from our Paypal account to our Bank Account.

 

Lo and behold 6 days later we are still waiting all the while our money(and hundreds of thousands of others)garners interest for them.

 

Great board btw,

letter in the post to ULSTER BANK LTD to try and reclaim the plethora of charges levied against me in the last few years.
