evening everyone.

 

my 1st letter i sent off one week ago giving 14 day response to my outlining claim is for £5587, now my question is for my second letter the intrest is a further £800. can my claim still be heard in the small claims court being its just over £5000? or should i knock the claim down to a straight £5000 and how would it look to the bank (abbey) that i have lowered my claim in the second letter?

Your interest is increasing by £800 a fortnight???, what interest rate are you using??

 

If this is statutory interest at 8%, it isn't added at the 'letters' stages, only when you file at court and is not included in the value of your claim. Claims over £5000 are not automatically moved from small claims so I wouldn't worry.

no no my friend

the interest is from march 2001- feb 2007 =£1289.78 and yes the interest is add at the court application stage.

just worried if my claim could still be heard in the small claims court.
