Hi All,

 

I am starting the court process for my Parents against halifax. Thing is, its a joint account so when using MCOL do u just use one person as the claimant? or do you have to do both ppl? if so how cause i cant see where you do it!

 

Any help would be much appreciated.

Hi Paul,

 

As a joint account owner, I presume they have equal full authority over the account. In which case, at court stage you can file the claim just in one name - whoever wants to 'man' the case, out of the two, so to speak :)

I am claiming for a joint account. As long as either party can withdraw and sign for things with only one signature (as opposed to both parties having to sign for every transaction) then you can use just one person as the claimant.

 

That is what I am doing, and have had no problems yet.

12-03-07 Halifax Received £1800

05-06-07 Halifax II Small Claim Served for £2503

Capital One - Won £768

Halifax Credit Card - Won £756

Yes Paul, forgot to add, as noodle says, I've already claimed like this, and been successful over my own joint account.

Court proceedings have now started :) I have done this process with Lloyds TSB successfully claiming back £2.5k!

 

Bring it on!

 

They are only claiming £800 so im assuming they will roll over quite quickly.
