hi CAG this is our first thread on this superb site :-)

 

we raised a claim with rbs for bank charges refund in dec 2006 totalling £5700 plus £ 1100 in interest .last week we received an offer of a good will gesture of £5500 after submitting a lba.

 

However we are now pursuing them for a better offer via a solicitor.Is this wise or should we take the money and run:confused:

Hello and welcome,

 

You should take them all the road, you will get the lot. You could also do it yourself without the need to pay a solicitor. When I started my first claim my solicitor did'nt have a scooby what I was talking about, in the end he said 'There's no way you could take your Bank to court' no, well I already have, 2 Banks and won both times. But in the end it's up to you, £5,500 is a lot of money.

Solicitors workin on a no win no fee just a bit worried we lose original offer bcos we are chasing them for more. Dont know if goin to the big boys court is the wise option . If rbs tell solicitor we are on to plums for more cash can we still claim the offer they made us

Buster you really dont need any legal assistance in my opinion solicitors are just another type of legaised robber, the no win no fee's people will be asking for 20-30% + VAT. And the thing is you are guaranteed the win.

Write back and accept their offer as a partial payment stating you do not accept this as full and final.

keep up the pressure and let them know you know what your talking about and there is no way you will be backing down.

 

Spend lots of time on this site, read and read and read. check out all the links to people like the FSA and OFT, read all the ACTs and statute, prepare yourself.

Other people wont do this for you, though many will help if you still cant find what you need after your own attempts.

can you guess Im a novice at this and hope to come thru the other side quids in .Got several other claims on the back burner ( citi cards,barclaycard blackhorse and rbs AGAIN ) so hopefully dont need the brief in the future ! Was advised by the clerk at sheriff court to seek help from solicitor as claim exceeded small claims limit of £1500 in scotland

 

who needs a brief when lve got you lot on my side

buster as for whether to accept the £5k, have a read through the successes forums. Plenty of people receiving plenty of settlements far greater than yours. Perservere!!

 

Unforunately, you got the advice from the courts first, but I'd advise you to get all your advice from here. There is enough information and helpful helpers to turn you into a master suing machine!! No need for lawyers, why pay them to do the easy work for you? I would consider the possibility of cancelling them. Do some research on the site, find out how to do it on your own and go for it.

 

Just because your claim is over £1,500 doesn't mean you can't split your claim down into £1,500 chunks now does it?

Why didnt i look at this site before jumping in !!!

Only 7 days to go before lba is put in the post. Will cancel lawyer at that point, he hoped to get us a better result by that time .Looks like i might have to accept the £5.5k (if i still can) or does anybody actually manage to successfully claim back the interest :confused:

Buster cancel the lawyers NOW. the meter is running the whole time !

 

if i was you accept the £5500 but be sure to say that you are only accepting it as a partial settlement and by no means do you accept it is a full and final offer.

If they insist on this then kindly decline it, you will get what you ask if you keep your bottle.
