    • Thanks in advance for advice! I was shocked to find out when doing a credit score search this weekend that I have a CCJ in my name. I've spoken to the courts today and have been told Vehicle control services have taken me to court for parking without a permit in my own allocated parking bay that came with my flat rental. The CCJ appears to be to the right apartment block but the wrong address.  It dates back to 2017. The judgement was passed in April 2021 without my knowledge of the ticket or the case ( presumably fine information was sent to the wrong address) I had already been taken to court by VCS previously for parking in my own bay and I won. It seems to me that this is underhanded behaviour from VCS as they had my address from previous interactions and had tried taken me to court for something that a judge had previously ruled on. I'm seeking advice on next steps. I was told by court that i can raise a dispute on the CCJ but I also want to appeal the case altogether. Should I be filing an  N244 Application Notice with an N161? I was told I should pay the court £303. Now that I've got home and had a look, there is a long list of court fees so I'm not sure which is applicable. I was also told the £303 is not refundable. Should I be filing a counterclaim or is that something that can be done at a later date. Ultimately I feel disgusted at having a ccj and then having to pay for the privilege of getting it removed. Any advice on how to make VCS pay for this would be appreciated!

    • As gesture of goodwill, we were eventually given a courtesy car from Mercedes (after numerous complaints from us on their lack of communication / misdiagnosis / time they’ve had the car - we’re now at over 4 weeks without our car) They have literally just informed us it will be ready to collect tomorrow. If we pay the cost, where will we stand? It’s so hard to understand what we should do 😫 we will re open our complaint with the finance company then. We emailed Doves yesterday informing them of all the problems (we have touched base with them and let them know prior to this) but they are yet to respond.    Any further advice would be greatly appreciated!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sent off my SAR on 27th January and letter was signed for as received on 29th January... Still waiting for them to cash my cheque for £10 which they havent got around to doing.. Still a waiting game for now..

eggopp, fancy seeing you in cap one forum, lol.Have started claim with them also but am being brave and claiming compound contractual interest. Have you thought about what you are going to do.

also waiting for my statements i think im going to go for 8% on this one as my first claim and then if this is successful and once i have got the hang of it go for contractual on the others.

Sent off my SAR on 27 January the same time i sent off SAR for Halifax CC's Halifax cashed there cheque on 7th Feb. Its now 18th Feb and Cap One still HAVENT cashed there cheque for £10.. Still had no acknowledgement from them at all!!

 

Has anyone else experienced such a delay before there money was cashed by Cap One? Anyone know how long i have to give them to provide the info? I know they normally say they have 40 days but i suspect this is another delaying tactic.. Anyone got any answers?

I would start to chase them up around the 35 day mark. A letter or a phone call.

eggopp, my cheque was not cashed, I did ring to enquire and was told they do not charge you for SAR so was not necessary to send cheque, I'm sure others have probably been told different though. My guess is you should receive statements any day.

eggopp, ring this number 0800 9524914 - I spoke to them yesterday as my hubbys 40 days are up for his SAR, I know they received his letter as I sent it recorded but apparently has not been entered onto their system, have sent letter from template library telling them I will take court action if I do not receive SAR in 7 days. So probably best to chase them. More fun and games.

Thanks Doo.. I rang them on 0800 9525150 press one and ignore messages before speaking to someone in person lmao.. likewise it hasnt been entered onto the system and yet i informed them the letter and cheque were signed for on 29 Jan 07, young chap said he will email them internally and get them to action it ASAP and then call me back.. Funny thing i asked for the email address and he said NO hahaha

eggopp, I think they are playing silly games and time wasting - we just have to keep on top of everything and not let them get away with it, am still waiting for my letter from them, apparently it was sent on 12 February, but they did add it can take 7-10 days to reach you, work that out.

**UPDATE** Hooray... statements recieved today, had a quick look doesnt look like much but will work it out tonight and get letter off tomorrow.. :D

WOW quick calculation and Prelim all nicely drafted up.. £350 without interest and £456.38p with interest at 8% was going to do contractual but couldnt find anywhere on statements that says what the APR is/was. Overall balance on the card before being tied nto my IVA was only £932.58p

 

Now if i did contractual im sure it would be more.. Will send it all off tomorrow unless between now and then i recalculate doing contractual.. Anyone know what the APR rate on a Cap One Classic Visa account was when i first took the card out in September 2000? Someone out there must have got a card about the same time :D

Look at your statements - you are looking for the purchase interest rate, that is what they have charged you, you can work this out x 12 then check on mindzai spready, enter your monthly purchase rate and it will confirm the APR. Also I rang cap one and it worked out exactly the same, so I went with this figure.

Purchase interest rate differs on each statement... For example. on my statement dated nov - dec 2000 i spent £160.67p.. purchases were charged at 1.67% yet a statement for May 2003 says 1.479% each statment differs... Am i looking in the right place doo?

It sounds like you are, mine differed a couple of times over the six years, go for the most current one, I'll check this rate for you on mindzai spready and get back to you, and then to double check ring them tomorrow and ask them the APR they have been charging to your account, I always like to know I have checked and re-checked, be back soon.
