Hi,

 

I have started the process against Lloyds to reclaim about £1,150.00 plus interest. Have got to the LBA stage when I received a letter to say they would refund £750 into my account as a "goodwill gesture". Went to the bank the next morning and the money had already been paid into my account.

 

I am going to write them a rejection of offer letter and need to file an N1 with the county court to claim the rest of it. Would I subtract the £750 from the claim amount or just mention it somewhere else in the form?

 

Any help you can give me would be gratefully received!

Yes you can subtract the amount from the total, dont forget to claim the interest on the £750 from the date the charges were taken upto the date they paid the cash into your account.

Have read a couple of posts on this issue, can I just subtract the amount from the total claim and be done with it?

 

Also, I didn't claim any interest from the bank as I thought it sounded like too much hassle but am being to think I should have done. I am meant to be filing my claim with the court tomoz, do you think I should just carry on and forget about the interest or delay filing for a few days and do the interest properly?

Hi, emsie-b,

 

It's up to you, I know it's a pain ! I lost count of the number of times I handed my court papers in, only to be told I had made a mistake and had to go home and re-do them. If the interest is a few £'s then take the time to re-do your claim. The money's better in your pocket.

The Interest will be a fair amount, I would advise you to add it. Work out your interest on the whole claim upto the date they paid the £750 into your account, then minus the £750 and work out the interest on the remaining money. Just change your dates on your spreadsheet to do this.

Oh and one more question, if I am adjusting my charges should I let the bank know in writing (with an updated schedule of charges) or just let them find out when the court sends them the documentation?

Have only just come back to do this as it is doing my head in a bit.

 

Should I subtract the £750.00 from the earliest charges (but then the bank owes me less in interest) or what? I think they are making these part payments just to confuse people and make them spend timer redoing calculations. They have successfully stopped me from taking this any further at the moment.:x

up to you personally I would do it from whats best for your claim....as they are unlikely to individualise their partial refund....so make the most of it.

OK - Lloyds paid £750 into my account as a "goodwil gesture" after I asked them for over a grand. I accepted as part payment as I didn't have much choice as they put it straight into my account. Since then I have worked out my interest (which i wasn't going to claim) is over £150 and if I went down the contractual route it would add another grand to the claim.

 

I am loathed to lose this money. I realise contractual interest is not a right and they will put up more of a fight and I might look like I don't know what I am doing as I left it till now to add on. But the truth is I do know what I am doing now as i have spent ages reading through stuff to get it all clear.

 

What do you think? If you were in my position would you cut your losses and continue with the claim as is. I really need to decide what to do as I should have filed with the court last month but have been dithering about.

 

I think I should go back to LBA stage, minus £750 fom my claim (if i attribute it to the date it was refunded it halves my daily interst which I think is being reasonable) and continue from there.

 

Aaargggh - what should i do?????
