I am attempting to remove 4 defaults from my credit history and this is the 1st one that I am posting here! Watch this space...

 

31/01/2007 - S.78 Letter - Do they still have the original agreement? This is for a default that Littlewoods had placed and sold the debt to Moorcroft I have been paying it for a few years now... worth a try :)

I recently conducted a check of my credit history report with Experian and I have a default notice in my name which refers to the above account, I have no record of the default and would like you to substantiate this data at your earliest convenience.

 

 

1. You must supply me with a true copy of the alleged agreement that refers to on my credit report.

 

 

This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number XXXXXXXXXXXXXXXXXXXX

 

 

2. You must supply me with a signed true and certified copy of the original default notice

 

3. Any deed of assignment when the debt was sold on

 

I request that this data is provided within the next 28 days, if you are unable to provide this data then I insist that it is removed from my credit files as unsubstantiated.

Hi . I have been looking at the default removal information concerning Litttlewods. I too have a default on my credit reference which i am trying to get removed. I notice Netyard mentions something about a Deed of Assignment when debt was sold on. Has anybody got any information. what this means and how it can be used. I believe there is a vast loophole here. A company will sell a debt for as little as 3p in the pound. But i am sure that all other information, such as the CCA Agreements are not passed on, so i believe they are buying a debt but not the legal right to enforce it. Every effort should be made to challenge every Debt Collecting agency for a signed copy of the CCA . Good hunting. Dave

Hi Everyone, I have a default from LITTLEWOODS TOO!!! It was issued to me 23/11/2005. I remember paying the amount (£428) but I had no idea they had issued me a default untill 2007 when I look at my report. Its absoulutely outragous how these companies can mess with peoples lives, as I have not been able to obtain credit or a mortgage since 2007, thanks to 1 default.

 

I hope there is a success with Littlewoods??????????????????

 

I'm about to send the letter, recorded delivery of course!
