    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I dont think I can change POC at this stage - it will cost another £35.00 and may be giving A&L an excuse to postpone. Also I read on another case it caused quite a few problems doing that at the last minute.

 

Why would they want a signed copy?

Your mcol poc will be great, dont send a bundle unless they ask, the judge wont look at it till the day.

Dont know about the icon....its been okay for me...are you using the reply to post or the smaller one at the bottom.

 

Only MODs can change titles.

HELP NEEDED PLEASE

 

I have appealed against stay to Aylesbury court

 

Did not send bundle as it said hearing was vacated but wrote a covering letter saying I would respectively await the judges decision and send the papers in if necessary.

 

I have recieved a letter today.

 

Your application dated 9th August has been placed before the district judge who directs that you must file with the court a signed copy of the POC within 7 days.Hearing 28th August @ 11am

 

Now do I just send a signed copy of the POC from MCOL which I printed off?

As I dont know exactly what the hearing is for do I send my bundle as well?

Why would they be asking for this ?

 

I have told Wragges by email today of the situation so I expect they will attend.

 

Any other help greatfully recieved

I used N244 and letter on here for section C

 

original hearing 28th august had been vacated.

 

Today the court replied and asked me to send in POC signed copy :confused:

 

any idea why:confused: I filed on MCOL originally and am aware i can not change these without an order - do I just sign the print out fom MCOL?

 

Also the original hearing is back on - but I have not been asked for bundle - I did not send it in as case was vacated .

 

So now I am in court on 28th august - I think for hearing on stay? or could be full case?

 

Any advice please:confused:

Never seen this before, can only think they've lost the original.

 

Suggest you phone the court and ask why.

 

Re: whether bundle is needed and whether stay or full hearing, again the best thing would be to ask the court

I agree with Jen ... don't submit your bundle yet; they've not asked for it, so no doubt this will be dealt with separately. At least you have it just about ready, which is great.icon7.gif

 

Yep, I'd go with your original MCOL POC ... I don't see any reason why you should amend it at this late stage if Wragge/the court haven't queried it before:confused: I'd just send a signed copy with a covering letter. Not heard of this one before but, at the moment, nothing seems to be set in stone and lots of weird things are happening so there's no precedent for anything.

Hi Jan, it looks like you have to send a signed copy of your POC. You could ask the court for clarification on it aswell.

 

Could it be that the court does not have a copy of your POC :o

 

The hearing may be to decide on whether the stay is removed or not???

luckily I printed the official MCOL document so will sign and send this.

 

I am still tempted to send the bundle to Wragges to show them I mean business and then just take mine in.

 

I guess it will initially be about the stay - so will keep reading up all arguments.

 

especially the one I saw today where the judge did not like the blanket stay and said the bank should have paid the £65.00:D :D :D

 

The worse thing is when the courts are so vague you are not quite sure how to play it - but after all this time I want to be fully prepared to argue my case to the best of my ability.

Jansus,

Be the self assertive person that you really are and give them hell. If your bundle is done, then send it in. My three took ages to do, and at first I too was undecided, but then I thought why do all this work for nothing, I don't want three folders gathering dust, so off two went and the other is propping up the kitchen table where i chewed the leg off.

yes my daughter!!!!

 

AS levels were C English and C for Art - pleased with that.

 

But U Psychology and sociology

 

Not happy!!! at least she did not come up with a long list of excuses- said it was all her own fault for not working hard enough. As she wants to take sociology next year we have to in to find out about re-take or doing AS and A level together in one year. She is not going to Uni so not the end of the world but I just get frustrated as I know she can do better. But we have never put any pressure on the kids As I said to her "the only mistakes you make in life are those you dont learn from"

 

She wants to be a plumber or some other building trade! and I have a son who hates football and for his birthday tomorrow is having a cocktail and casino party- its a topsy turvy world!

 

Actually quite a special day tomorrow as my son was born 20 years ago as a premature baby of 2lb 7oz at 29 weeks and went through lots of traumas when he was in hospital for 3 months. His birthday should be 5th November! So always a time of reflectionon his birthday.:)

Re XXX V Alliance and leicester

Then hand written is "hearing 28th Aug @11am"

 

 

thats it!

 

 

I have advised the banks solicitor that I have appealed against stay - but have had no reply from them

 

 

The above date was the original date for hearing. when I send N244 and letter from here, I said to judge That my "bundle " was ready but I had not sent in as I had received letter about the stay ( which was on courts initiative). And that therfore I would repectively await his final decision.

thanks so much for your post very useful

I have been searching all night and unfortunately all the ones I found today had lost their hearings trying to lift the stays.

 

I think I will definitely send the bundle in Monday by recorded delivery just to show the judge and Wragges that I mean business.

 

I will be nervous and can not claim the hardship clause that some have - but I want to give this my best shot as I know that A&L had no intention of ever defending and I think it is such an abuse of the courts time - they have much more important things to deal with.

My case is against A&L

 

Case was stayed on 9th August - bundle due in by 14th -case was 28th August

 

I used the template on here to appeal stay then on Thursday had a letter asking for POC signed ( I will send in MCOL signed) and ahand written said case 28th Aug 11 am

 

I have also after lots of debate decided to dend my Bundle to solicitor tomorrow and the court .Although I think the hearing on 28th (originally full hearing) is now just about the stay.

 

I am really just looking for how I can best argue this.

 

I have seen cases on here where the judge went through the template - and still awarded the stay.

 

I can not argue on a hardship basis.

 

Over and above the appeal document what else can I say - can I use the fact that The bank had no intention of defending ?

 

Help needed please.
