Hello All

 

After months of "thinking" about it I finally sent my SAR on Friday of last week, recorded to the Trinity Road address. Thought I would call today just to check if they have received it (royal mail website says it hasn;t bene signed for) the guy told me I should have sent it to their main address in Leeds, initally they had told me to send it to the Trinity Road address - what are they playing at? Now he recons they will have to re-send it to Leeds, how long will this take, and what are the chances of it getting lost? He also asked me for my Home/work and mobile number, never been asked for it before why now? They have totally wiped my out with their bank charges, even taking it umpteen times out of my family allowance which always takes my overdrawn (would never give me an overdraft), my mortgage, varies insurances are also with them, never had a problem with them, just my crap card cash account - any advice, I would really appreicate it.

I've just sent my SAR off today to the registered address of the Data Controller which was Trinity Road in Halifax.

 

I got this address from the data commisioners website and this address is the address that Halifax have registered with the comissioner. The Registration Number for them is: Z4788640

 

At this stage I would guess you imediate issue is with the Post Office as they are the ones who should be delivering it and getting a signature on your behalf.

 

From what I read in the forum how to, SAR's need to be sent to the data controller at the Halifax address. Where Leeds comes into it I'm not sure.

 

Given that most of the muppets I've spoken to on the phone at the halifax are ignorant of the facts and trained to act like monkeys on behalf of their bosses, I'd stick to your guns.

 

Chase up the post office at this stage and see why they haven't delivered and collected the signature that you contracted the post office to do on your behalf.

I did address it attn: Data controller, spoke with the post office, they said it can take up to 5 days!! Will ring the halifax again I recon and see if I get the same answer. As we are at the same stage, it may be nice to check up on one another

Suprise, just called the Halifax, they again told me that it should have been sent to their head office in Leeds, but he checked and they have received my request, still no confirmation on the Royal mails website - very odd - but at least they have it, lets hope they pull their fingers out and sent me my statements asap!

Hi Mousey - yep we are at the same stage and yep ... I think it would be great to keep checking on each others progress. If nothing else we are in the same boat. It's just you've had a few extra days paddling to me :)

 

I've put a link to my thread in my sig so feel free to pop over and subscribe to that. Between us and all of the other help available in this forum I'm sure we'll be OK.

 

Personally I think that the financial institutions should also be help accountable for the wrong and misleading information they allow thier staff to give out over the phone. I have over 60 hours of recorded calls and the rubbish they come out with is amazing.

 

Why do I know it's amazing? I used to work for a bank and was trained to a higher level than most due to my position.

 

Now it's got to this stage for us the only strong suggestion I can give you is 'Make sure it's in writing' . What you say on the phone and what they say on the phone will be two VERY different things to what gets put in the notes the 'advisors' write.

 

Keep in the back of your mind these things as well:

 

The people you talk to are not always as well trained or informed as you would hope.

 

The people you talk to on the phone have targets to meet on the number of calls they take and in many cases part of their wages will be based on the volume of calls they handle as well as the quality of their handling of those calls.

 

Just because you hear a recorded message saying that the bank may record a call, does not mean that you can get access to it to prove what you said. It has been known for banks to 'lose' those recordings IF in fact they are being made.

 

If you do start recording your calls, you MUST tell the person you are talking to that YOU are recording the call.

 

As an individual, the call center agent has a PERSONAL right not to talk to you but YOU have the right at that point to be asked to talk to their manager or someone who will talk to you. If you don't state that you are recording a call then you can't use it in evidence should it come to it.

Hi All

 

Halifax received my SAR on the 24th January, still nothing in writing received to say they have actually received my request - is this normal?? Rang them 3 times, 2 people said it had been received, 1 said it hasn't, Royal mails website said it hasn't been signed for, but recon the Halifax would have signed for a job lot!! They sent me £3.00 worth of 1st class stamps for the inconvenience!!

Hi Guys this is interesting reading i am also at the same stage as you both i sent sar 10/01/07 halifax acknowledged 17/01/07 via letter saying i will recieve the s/ments withinn 10 working days it is now 5/02/07 still not recieved s/ments. rang halifax today to find out they say the s/ments have never been ordered and will be ordered today i was fumimg but not surprised but they have untill 20/02/07 when 40 days are up Wath this Space regards giggles

Hi guys

 

Yes i got my s/ments after another 5 days, sent prelim then LBA and today i have come home to a letter from the halifax to settle in full at £3032 but i have a charge coming out of my account on friday 9/3/07 for £39.00, so i rang the guy up to say i would settle if they reversr the charge on friday and he said no the charges are untill 6/03/07, this really got my back up and i explained that if i carry on tp court that they will have 8% to pay as well, he just replied that you do not have to accept it its up to you, now coz i am angry i dont no what to do shoul i continue or cut my losses and run with the money please Help !!!!!!!!!!!!!!!!!!!!!!!!!!

I wouldn't know either, I sent my LBA on Tuesday so haven't heard sqaut of 'em. I think reading the other threads you should maybe hold on incase you get anymore chanrges, the 8% makes a lot of difference also, it is tempting though.

Hi Mousey, a insite to time for you might be my situation, sent SAR on 22nd Jan, got reply on 9th Feb stating that information would be sent and some crap about manual intervention on account, got statements on 25th feb :),sent request for refund of charges(£2210) on 26th feb, next reply came on 3rd March, HALIFAX were sorry that I was unhappy and they stated that they have 8 weeks to respond...I think not, filed MCOL yesterday £2210 plus 8% £614.46 total £3018.46, same feelings as others on site, o my , I have just taken my bank to the small claims court, scary.:!:
