    • I purchased the vehicle using finance through motonovo under a HP 60 months agreement. I have now amended the document ensuring all is in black. Unfortunately, this email has now been sent. However, I have not sent a letter to big motoring world. Also, I have taken the section of the firealarm issue. I am struggling to convert to PDF. I am not tech savy at all. My mistake was that the the salesman was very fussy on a sale. We went down a quiet road for a little test drive and not for a lengthy road test. The water issue was not present at this moment of time. However, it only became prevalent after driving away, after all docs signed. I did stated to Audi I wanted a diagnostic report. However, they carried out an Audicam which is footage of the issue. Audi have diagnosed the issue as a common issue where coupes/cabriolets accumulate water in the seals. However, I did state beforehand for no issue to be rectified due to me wanting to reject the vehicle. I am awaiting a report from Audi through email from the branch manager in relation to the issue. The issue so far is the water still being present in the sills. Audi tried to fix the issue however the problem is still prevalent. Regards

    • Right,  so the court hasn't send out the Directions Questionnaires/N180s yet. PE's one is a false one, meant to intimidate you into thinking your defence was rubbish and they are confident with their claim. This is par for the course.  The PPCs do this regularly. However, PE have gone further and written that "a copy has also been filed with the court" which is a lie as the court haven't even sent out the papers yet. Keep a screenshot of MCOL, later on in your WS you can draw attention to their lying and abuse of court procedure. If you've got time on your hands, then complain to the BPA about one of their members lying.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No They May Collect For Hsbc Aswell But Definately Owned By Lloyds Tsb I Asked Tsb This And They Confirmed It , Lisam

 

Sorry to disagree but The Beneficial Financial Bank is a trading name of The HFC bank who are in turn part of the HSBC group.

 

Beneficial do not offer bank accounts but merely offer loans/credit cards etc

blair oliver scott for taking £150 out of my halifax account on friday for a debt that was cleared in April 2006!!! :mad:

 

letters winging their way to Halifax (for giving out my account details) and Blair oliver scott for taking money that isn't theres to take!!

 

the debt wasn't even owed to them but to geoffrey parker bourne who this morning have confirmed the balance was cleared on the 21.04.06 :evil:

I have had dealings with Arrow Global, who passed the alleged debt straight onto their evil Solicitor, Eversheds. They have since shut up and neither have written to me for about 2 months now since MBNA tried to falsify an agreement.......

Just interested to know about Blair Oliver Scott - some people write as if they are just a DCA and others that they are solicitors - can't find them listed on the English or Scottish Law Society websites - any ideas? And what is the relationship between them and another HBOS DCA - J&J Collections? If Blair Oliver & Scott arn't solicitors who do HBOS use for litigation?

I couldn't comment on them as I have no dealings with them at all. I suggest a general search may throw up some more "victims" who will be able to confirm one way or another.

B,O&S are trading as previously informed, I think they act as a collections agent but have had no dealings with them as solicitors. I can supply details of my dealings if needed

this is very confusing ...1 month ago I just got a loan of Welcome finance ...I think this is how Capquest has caught up with me :-(

but havent received no paperwork confirming the loan ...waiting to see if they start the d.d. this month .. how can they trade if they are dormant:?:

Nino1 - Arrow is part of a bunch of Yankee come-latlelys who are going to teach us poor downtrodden Brits how to collect debts effectively - just like the G.I.s won the war for us. Given the scumbags already in the market my view is they've left it a bit late, but perhaps they've just found Pearl Harbor on an atlas.

 

My beef with them is that they devote a whole page of their website to slagging off the CCCS - "Gee youse guys - when your creditors chose CCCS you should have done chosen Arrow" (or something similar).

 

In my view quite libellous, but confirmation that the CCCS has gotten under their motherf*****g hides.

Hi i have just read the whole of this thread, and wow, it has blowm my brains out. anyway I am a newbie to all of this. but I do have letters and phone calls from Buchannan Clark & wells, chasing my debt for Natwest bank. I have only just cca they they signed for it yesterday, but can someone please explain the bit about being dormant (them not me!!), if they are dormant does that mean they should not be chasing my debt, and that i do not pay them anything, what if they can produce my cca, then what. please help

Just heard from B.O.& S. in the Republic of Scotland.

 

Their letterhead states 'Debt Collectors'.

 

Registered Office: Arrol House, Viking Way, Rosyth KY11 2UT.

 

Registered in Scotland No. 133457

 

Claiming to act on behalf of "Halifax" they begin: Blair, Oliver & Scott Ltd. is a professional debt collection agency blah, blah.

 

Call our Helpline Number 0870 240 5138 (sic).

 

Our comrades-in-arms 'saynoto0870' give the alternatives of 0131 4427777 (Switchboard HBOS ask for Blair Oliver and Scott to get through) and, by lucky hap 0800 0560808 (Part of Halifax (HBOS).

 

Doesn't sound very dormant to me!

These parasites don't have much imagination.

 

To make sure who you are looking for, Google (UK sites only) "First Credit" and you'll get their website. When I tried it was the first name to come up. They are based in Evesham.

 

Then go to the second page (I think it was) of Google's list and click on 'Odd telephone call from First Credit Ltd.' and you see a whole can of worms opening up.

 

That's 1st Credit and they too have a web site, but as far as I can tell no connection.

TOTAL Confusion - EOS Solutions UK (Warrington) were called Logic Group until Sept 06.Logic Group (Edinburgh) were called Collection Agencies until Sept 06.Collection Agencies (Warrington) were called EOS Solutions ltd until Sept 06.EOS Solutions ltd (Warrington) were called EOS UK Holdings until Jun 06.EOS UK Holdings (Edinburgh) were called EOS Solutions ltd until Jun 06 , then EOS Solutions UK until Sept 06. FULL CIRCLE!! How can they just swap their names around like this??
