    • Morning,  I have recieved a reply from my request for information. They have replied with the credit agreements for my 118 loan and two Captial One cards.  They have said thay as Vodafone is a telecommunications account it is not regulated so the original creditor is not obliged to provide a copy of the agreement.  What are my next steps?  Thank you

Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi smirk, i am also waiting for an AQ, however i received a court date for 26th March without receiving an AQ, from what i can workout from advice and other threads i am going in for a case management conference, which i think is a pre-allocation hearing, the good news is that Natwest seem to pay up before this happens, i will keep you informed of what happens next, not long to go now hopefully:)

Had a letter from Natwest today... in response to my SECOND letter dated 18th December. Despite the fact that my claim has moved on since I sent that letter and court costs have been paid already, they've offered me a settlement figure.

 

 

 

Its for the exact amount of my penalties. No interest. No accumulative (8%) interest either. AND I'm out of pocket for the court costs!

 

If I reject this settlement I'll have to wait longer (perhaps two more months) but I stand to gain the full amount - £900 more than they're offering me now.

 

What shall I do? Call them or write to them to reject?

 

The settlement offer letter came from Stuart Higley, not Cobbetts. Should I write back to Stuart Higley and copy the letter to Cobetts and the Court?

 

Any advice you can offer would be much appreciated.

Well all the hard work has been done, i would hold out now for the rest don't give in now take them for every penny they owe you and its the interest and court cost that they do owe you.

The offer from Natwest came thru the day before the AQ from the court.

 

Thing is, I've since spoken to Westy here on the forum and he says I should be using a different spreadsheet - I can email it to you if you like Fireman.... he's claiming 17.95% 'authorised' intereste... and he says I should be claiming 29.96% 'unauthorised' interest. Now I'm confused. My spreadsheet says 8% but Westy claim its an old one... its still available to download via this site though. Please tell me which spreadsheet you are using.

If you want to change your claim for contractual interest it will mean starting again as you have claim this from the preliminary stage. The 8% you are claiming at the moment is the Statutory interest under s69 of the County Courts Act.

Thats fantastic news pleased for you, well done! Did you deal with Cobbetts in Manchester as that is who i am dealing with? Oh well i am off to hand in my AQ on Friday before i go on a course next week so lets hope i get the same reply back as you? WELL DONE AGAIN!:D :D and one for Nat West :p !
