re: Particulars of Claim

I've tried to paste the info as detailed on the template (N1)... but there seems to be too many lines/characters for the online form. Please can anyone advise me how they completed this part of the online form?

Thank you so much.

Does the total amount of my claim INCLUDE the 8% interest or not? Or does the 8% get added on after?

Please advise

Fireman:

Cobbetts have declared that they intend to defend the whole claim, so I'm sat here waiting for the AQ to arrive. :(

hi smirk, i am also waiting for an AQ, however i received a court date for 26th March without receiving an AQ, from what i can workout from advice and other threads i am going in for a case management conference, which i think is a pre-allocation hearing, the good news is that Natwest seem to pay up before this happens, i will keep you informed of what happens next, not long to go now hopefully:)

:)I am not an expert at this, any advice i give is from reading posts on this site, its all in here somewhere :)

:) If i have helped please click the scales:)

Keep your chin up it won't be long now and the cheque will be with you the sooner this AQ/Pre allocation hearing or what ever they throw at you will all be worth it in the end! Good luck ;)

Had a letter from Natwest today... in response to my SECOND letter dated 18th December. Despite the fact that my claim has moved on since I sent that letter and court costs have been paid already, they've offered me a settlement figure.

Its for the exact amount of my penalties. No interest. No accumulative (8%) interest either. AND I'm out of pocket for the court costs!

If I reject this settlement I'll have to wait longer (perhaps two more months) but I stand to gain the full amount - £900 more than they're offering me now.

What shall I do? Call them or write to them to reject?

The settlement offer letter came from Stuart Higley, not Cobbetts. Should I write back to Stuart Higley and copy the letter to Cobetts and the Court?

Any advice you can offer would be much appreciated.

Hi Smirk

Well all the hard work has been done, i would hold out now for the rest don't give in now take them for every penny they owe you and its the interest and court cost that they do owe you.

Keep going Smork and good luck, sounds as if you haven't got far to go now!

Thanks Fireman! Guess I'll reject the offer and wait for Cobbetts defence. By the sounds of things, responding to that is a minefield in itself!

Have you actually recieved your AQ yet or did they make you that offer before it arrived? I have got to the 17th Feb before i get my AQ looking forward to it. Keep us informed and keep going!

The offer from Natwest came thru the day before the AQ from the court.

Thing is, I've since spoken to Westy here on the forum and he says I should be using a different spreadsheet - I can email it to you if you like Fireman.... he's claiming 17.95% 'authorised' intereste... and he says I should be claiming 29.96% 'unauthorised' interest. Now I'm confused. My spreadsheet says 8% but Westy claim its an old one... its still available to download via this site though. Please tell me which spreadsheet you are using.

If you want to change your claim for contractual interest it will mean starting again as you have claim this from the preliminary stage. The 8% you are claiming at the moment is the Statutory interest under s69 of the County Courts Act.
