Parking Eye ANPR PCN claimform - Lake Street Leighton Buzzard.

Hi all,

My Daughter has just returned home to Sheffield after staying with us for the last four weeks helping out with my Wife's care as we at at hospital every weekdays.

During that time those lovely folks at Parking Eye issued a CC claim against her for an unpaid PCN from December 2021.

The date of the claim on the summons is March 20th,

I was under the impression that she was out of time to acknowledge it or defend it but she was able to acknowledge it via MCOL.

Am I right in thinking that this is correct and she now has the additional time to defend as MCOL permitted her to perform an AOS?

Date of issue – 20th March 2024

Date for AOS - Today, 13 April 2024

Date to submit Defence - 19th April 2024

What is the claim for

1. The Defendant (D) is indebted to the Claimant (C) for a parking charge(s)issued to vehicle ******* at Lake Street Leighton Buzzard.

2. The PCN(s) were issued on 03/12/2021

3.The defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: Vehicle Remained On Private Property In Breach Of The Prominently Displayed Terms And Conditions.

4. In the alternative the defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.

AND THE CLAIMANT CLAIMS

1. £170 being the total of the PCN(s) and damages.

2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.3 until judgement or sooner payment.

Please do the PCN one too as dx asked.

Are you sure she didn't receive a Letter of Claim?  If so we can add that point to the standard defence.

This is done now. My daughter and her fella are currently in the process of remortgaging so they just paid it out of panic.

Thanks for coming back and letting us know.

Obviously we totally disagree with their decision.  Their remortgaging could only have gone wrong if they had ended up with a CCJ.  And how do you get a CCJ?  If you lose in court and then defy the court and don't pay.  Even if you lose in court, you don't get a CCJ as long as you pay within the 30 days ordered by the court. 

Even had they lost in court the judge would have disallowed the interest and the £70 Unicorn Food Tax that PE made up.  There was no advantage whatsoever for giving in and paying now.

But thanks to you for letting us know - a hell of a lot of users don't.
