      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Been saying for ages that it would be July, because the longer it went on before calling an election, the more annoyed voters would become.  Any Government becomes unpopular after more than 10 years in office.

Sky's political correspondent was removed from the election launch and thrown out of the building. Good start to the campaign.

In other news, Steve Bray has been banned from a lot of streets near Parliament and No 10. Two people complained about him playing 'Things can only get better' while Sunak was making his announcement about the election. Under Braverman's new law/rules, this is all it takes.

Going in July makes sense, because allowing more time for negative news to keep hammering the Tories would just reduce support for them further.

It flights to Rwanda had started in June or July 2024, but thousands were still crossing the channel, it would prove the deterrent policy was totally ineffective.  The weather during the summer is likely to mean more migrant crossings.

And having listened to some economic discussions on radio recently, the Government are building up more debts they have to pay interest on. So there was no room for tax cuts in an Autumn mini budget.

Governments go for quick elections if they believe the months ahead are likely to be worse for them.

So you don't agree with Rory Stewart and the Tory MPs he talked to, UB?

Another possible reason is that there have been rumours in the City recently about a large group of MPs wanting to get rid of Sunak. He's said previously that he would rather call and election than be ousted by the party.

I've even read this morning that a gang of MPs want to remove Sunak before next Thursday [dissolution of Parliament], put their man in and call off the election. One journo has mentioned that a lot of MPs thought they had another 6-7 months to get their lives in order and this timing doesn't suit them. They think Sunk is being selfish.

I've just seen this. According to the Times, the decision to call an election was taken a month ago.

So Sunak went on Loose Women, told everyone they could book their summer holidays and not worry - and lied.

yes don't agree with Rory and the MP's he had contact with. Rory said most of these would be stepping down and they most likely thought they would be OK until November.

For the reasons mentioned, as the year progresses, the Tories would be facing more crisis moments and bad news, so going now is best timing.

Starmer better get a handle on these second jobs and ban them for all MPs as a matter of prime urgency. Then stop all the oustanding crony payments and get the chargebacks going while he sorts out the country.

Agree with this article.  If the Tories could have held a tax cutting budget in Autumn 2024, they would not have gone for a July election. The economics are incredibly difficult for any party in Government. Massive debts have been piled up increasing the amount of interest being paid. I doubt the last National Insurance cut was really funded by funds available and relied on additional borrowing. And as Truss found out, borrowing to make tax cuts has consequences.

There's lots of speculation in the weekend press about the timing of the election. One theory I could agree with is that it was a fit of pique because his charm offensive on voters hasn't made any difference at all with voters.

I can also buy into the theory that he has a job lined up in California. So the daughters finish the summer term in the UK, have the summer holidays to settle into the house in California and start school over there in September. He has to hope he gets his green card back.

I would love to see him lose the seat for Richmond but if he doesn't, what's he likely to do? Assuming the Tories don't win, is he going to resign as MP and let them have an immediate by-election or be a very part-time MP with a job 5,000 or so miles away?

If the Tories lose and Sunak is still an MP, he would probably resign as leader of the Tories and as an MP. Before Parliament goes into recess for Summer, Government would pass relevant order for a by-election which would take place early September. 

Read an online prediction that the Tories could be down to less than 100 MP's.  I think it is more likely they will have between 150 to 200, as some voters might be concerned by giving Labour too big a majority and reducing Tories to a number that might take over 10 years to recover from.

Dont forget about half the previous so called NI 'tax cut (as if - tax shift and increase in actuality eh?) was funded (just the recent costs) from piling somewhere around 4 billion quid on top of the taxpayers existing record debt mountain and added a requirement to further cut services on top of that wasnt it?

So pile £4,000,000,000 extra debt on the taxpayers credit cars to give them a couple of quid ..

 

... and the 'draft of sunaks is just a plot with the hope of forcing 18 yos to work for free in the NHS and care industries isnt it?

- certainly doesn't do squat for the 18yo or a professional army that hasn't got the money to equip or train them.

Late scramble for candidates 

The Conservative Party, having been taken by surprise by its leader calling an election four months earlier than expected, still has to find 32 candidates in seats it currently holds, according to Michael Crick, who is keeping a tally. 

 

If we assume that half of those will be lost, that means there are 16 safe Tory seats going for candidates favoured by party HQ, including, presumably, for Ric Holden, the Tory party chair, whose NW Durham seat has been abolished. 

 

 

 

Lucy Allan, (CON) MP for Telford, who announced last year that she would be standing down, endorsed the Reform UK candidate in her seat – she was suspended as a Conservative for her last four days as an MP, until the dissolution of parliament on Thursday.
