I am currently in the process of claiming back charges from HSBC and my nan mentioned that she gets a lot of charges from Alliance & Leicester.. so, I have decided to do all the letters etc on her behalf (obviously they wont know that!) to see whether we can get her some money back!

 

I am however stuck at the first hurdle (letter 1 - request for info). Does anyone know where I send the letter? Should it go to the address on top of the letter? (A&L, Customer Service Centre, Bootle, Merseyside, GIR 0AA)

 

Any help is much appreciated.

Hi, I've just got past this step - I sent the letter to them there and had a reply in under a week (about 4 days - I can't check at the moment). Apparently they think that I'm wrong. Obviously, I'm going to agree with them at this stage and just stop.

Yep thats the one. And you will be happy to tell your nan that A&L have a publicly stated policy of paying all claims.

 

But - warn her that they will close her account afterwards.

Please ignore my previous comment, I have just been told that my Nan has today received something from A&L so I am going to have a funfilled weekend of adding up her charges and getting letter 1 ready!

I have had a quick through my Nan's 6 years of statements and there is approx £1200 in charges.. which will be great if I can get back for her. The only thing is, it looks like she pays between £5 - £10 per month to A&L for having an overdraft (even though they still charge her for going over it and being overdrawn).. Can we claim the £5's back or, is this likely to be something she has signed up to and therefore having to pay each month?

 

If that doesnt make sense let me know (it is quite late!).

I have decided that I am going to add the £5 pm charges into the claim for the money back, worst case scenario they will say we cant have those back.. guess its worth a try and I cant see how the costs are fair anyway!

just to repeat what i said on the previous post, it sounds like your gran has an agreed overdraft with A&L which they charge £5 per month for. Unfortunately, you cannot claim this back

Send the SAR to the address you have listed - thats fine and where I wrote to get my brother's statements. Took about 10 days to receive them.

If I send the first letter requesting the charges back and leave the £5's on, will they just write and tell me that thats what the charges are for and therefore when i send my next letter, I take them out or do you think I should assume she pays to have the od and therefore take them out before the first letter is sent?

 

one year the charge each month was £5 and then another it was £8 and another it was £25! There was only one month in the 6 years that she wasnt charged it.

 

Im sorry to be a pain, I dont want her to miss out on anything!

Please ignore my previous comment.. I have looked at the A&L website and you are correct, my nan does pay £5 pm for an overdraft. The only problem is sometimes she is charged more than £5pm (ie in 2001, it was £10pm and now its £8pm). Do you think I should just minus £5 per month from each of the 'monthly overdraft charge' and claim back the rest?

 

When I have submitted my claim for HSBC, it was soooo much easier!

If i remember correctly, the £10 charge in 2001 was for an unauthorised overdraft (and the £3.50 per day). I checked my statements and it appears that where my account was in credit for a full month, the following month i wasn't charged anything for my arranged overdraft. It was only in the last few years they have started charging the £5 for arranged overdrafts. When i started my claim, i only claimed for "Paid item charges, Failed direct debits, and unauthorised overdraft charges". I wouldn't add the £5pm charges on your claim as they are agreed fees for the arranged overdraft

You Should not be claiming for the £5 "Monthly Overdraft Charge"

 

You will probably find on the statements that the monthly £5 charge is a fee for the overdraft and added to this is Interest on the actual overdrawn balance (In my case £3.29) on the statement I am now looking at.

 

I did not claim for either of these fees as they are legal and it could be argued they are not too excessive.

 

Send your preliminary letter claiming for the amount of only the unlawful charges, such as direct debit refusals, exceeding overdraft fees, unauthorised overdraft etc

 

Enclose a list of these charges, with the relevant details (Schedule of Charges) when sending the prelim letter good luck

The 'monthly overdraft charge' of £5 per month I am happy with as my nan would have agreed to that. I have gone through 6 years of statements and some months the charge is £5 (which I wont be claiming back) but on others she has been charged £8 / £10 or £25 - I think on top of that, she then has the standard interest (that I also wont be claiming back). I have therefore added anything above £5 for the 'monthly overdraft' onto the schedule of charges and I added a comment to the bottom stating 'Please note that monthly overdraft charges are only being claimed for amounts over £5, as this is the agreed charge' The amount I am claiming is £944.50.
