Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No court date. Has been transferred to my local court. They've sent their response. 

 

Not sure where to go from here.

They have the original loan agreement.

The default notice, is very poor, I suspect re-typed.

They have a breakdown of payments made.

Can you see a chink in this or am I paying out?

ignore what i said above, i forgot this was not the shortfall after a repo but a simple secured loan.

12yrs doesnt play a part but i see that you paid money to kenny's within 6yrs of the home sale anyway.

 

let @andyorch comment .

 

why have they inc a sheet about the home repo and the shortfall of that, who repo'd you platform or kenny's

but they were not your 1st mortgage provider were they ....platform were , and surely your main mortgage had a far greater sum owed at the time of the kenny's repo??

 

going strictly by the POC,  its the £10k (ex-secured) loan, but looking at their paperwork, it could be house sale shortfall?

 

another interesting point, is the agreement compliant?, it states the amount of the loan (£10k) + the interest charges (£24,974)  but does NOT state the total of the loan = £34,974    (which = your payments of 300*£116.58).

 

mortgage advance from money partners/ownership of mortgage kensington/brokers starloans all ... on that one agreements too.

 

but why inc that completion advice letter, completion of what, the secured loan? the repo of the home?

 

why have they stated:

 

total payable (for what!!!??) £80,609

client redemption (for what?) 95,445

shortfall (odf what) £14,846

 

also what the beep is asset manager invoice of £3,960.

 

do you have all the statements for this £10k loan yet?

 

to me, and i might be a tad confused, but to me that looks like they are after the shortfall of the home sale ?

I believe that for the repo what was owed to platform, what the property was sold for and the shortfall yes. 
 

That’s everything I have now. 
 

So yes they started the repo, got a shortfall as a result, still seeking the money.

you must inform all your debt owners if you move.

 

if you leave say a property asset in your name then obv a risk of court litigation would exist.

Just to let you know that I have had a notice of discontinuance on this case.

 

Thanks for all your help on this. I will make a donation in thanks.

 

I have also been contacted by Ascent Legal and they asked for a payment plan. The lady was very nice on the phone. I told them I didn't think paying was worth it and asked what would happen if not. They said nothing.

 

I was also contacted by Hoist finance for a debt from 2010 (credit card) and I said that was 13 years ago (at this stage they were giving me a 90% discount) and that it was too long ago. They actually asked me 'Does this mean you believe it is stat barred?' and I replied 'yes'. They said, ok, we agree, we'll shut this down.
