      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

mmm 130 -140 miles from the East coast old folks retirement areas around Ingoldmells to Birmingham - each way

 

Like many of the 'UK' weather maps, the Midlands east coast has already sunk into the sea as far as they are concerned it would seem.

The government has changed the rules on taking questions from the public at covid briefings, so they can cherry pick the questions and have advance notice of what they are,, instead of the current system.

 

They might as well write the questions themselves.

I dont think anyone with a shred of honesty or, decency,

would think that 2 people, going in separate cars a ten minute travel to go out of the way of crowds to exercise together as specifically stated in the rules was wrong,

and that some tosspot cycling 7 miles with an entourage of security, through a busy part of London to a crowded park, or some other tosspot travelling across the country to beauty spots to 'test their eyes' was right.

 

But then again, as we know - Johnson doesn't have the slightest shred of honesty or decency.

 

He's rather see his doners make millions from taxpayers while supposedly 'feeding' hungry kids for a week with less than he has free for breakfast.

Just like he's see billions into his pals hands for not testing or tracing

Noticeable in the Finnish pack was the inclusion of eggs, a most egregious omission in the Chartwell less generous than a day's ration from a foodbank pack

let alone that the alternatives include some decent bread - not that super processed 'dead bread'  that mummifies over time.

Thought the UK had banned that super processed plastic bread decades ago.

Apparently Tory Scummiest of **** minister Vicky ford isnt banning Chartwells (WHAT!) and is continuing to press the Tory **** 'food parcels first pressure, has said:

 

"“Chartwells has rightly apologised and admitted the parcel in question was not good enough. I met their managing director earlier today and he has assured me they have taken immediate action to stop further deliveries of poor-quality parcels. They will ensure schools affected are compensated and they will provide additional food to the eligible child in line with our increased funding.”"

 

Chartwells added:  'from next Monday would ensure food hampers reflect the additional £3.50 a week allocation per pupil receiving a food parcel at home.

 

So a bit extra compared to what those pictures show (about an extra 50p - £1's worth to a pack)  based on the existing 'value'

 

So more taxpayer money to Chartwells - NOT penalisation.

 

ALL school authorities should now STOP using Chartwells immediately, cancel any outstanding orders as unfit for purpose and supply vouchers for use at supermarkets/shop chains

NO IFS BUTS OR MAYBEs

The simple blatantly obvious (IMO) fact that they would send that pitiful crap to feed kids, while very clearly profiting immensly from it should exclude them from supplying food to anyone (except Tory ministers)

- - claiming that it was some sort of 'error' is just adding insult to injury and abuse.

 

'Sorry your child has developed malnutrition and rickets - its just an admin error and you can be sure we'll look into it in the coming months after we receive more taxpayer money, and will credit any we consider don't meet OUR standards once out execs come back from spending their profits in Barbados

- - -  E your own SAD comes to mind.

 

That Ministers would NOT immediately remove any contracts from such a company and have food standards investigate, but instead give them MORE taxpayer money, defines those ministers as profiteering child abusing ****

 

Both deeply saddens and enrages me that any UK government could be a part of such obnoxious inhuman behaviour.

 

Johnson claims to be a traditionalist - well more like a Dickensian'ist

- well, there is little doubt in my mind that he and all his ministers should be very 'traditionally stripped of position and a 'traditional' Dickensian public punishment applied.

 

Schools must immediately refuse to use this company
