Please try and explain your story as fully as possible but in a chronological order.

It is difficult to read an unbroken block of text.

 

Jacobs were instructed to collect CT arrears. 

Received letter from them end of January 2019 - promptly paid Council at beginning of Feb 2019.

 

Bailiff attended this morning at 9.00 am.   

He was not afforded entry.   

He keeps calling my mobile and sending text messages threatening that a removal van has been booked for 6.00 am tomorrow morning,   

Obviously, this is a lame threat as he hasn't had access to the property, hasn't done a Controlled Goods Agreement (or whatever they're called now) and hasn't spoken to me.

 

Am I right in understanding that Jacobs are unable to remove goods, etc purely to collect their fees?   

The initial fee of £75 is valid and will be paid as that was requested in January. 

I don't know if the second stage fee of £235 is arguable?   

Can anyone advise. 

 

BTW, I'm an OAP now.

if you didn't pay the £75 within 7 days and jabobs have since attended then yes sadly I feel the £235 is due as well.

let the experts pop in and decide.

 

when you paid the council did you only pay the owed CTAX?

they might have already paid the fee to the bailiff as they should have I believe?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Looks like I may have to come to an agreement to pay Jacobs' fees.   Hope they like £1/month.

 

As regards the threat to remove goods - thought they couldn't do that if the CT arrears were paid -- and that they couldn't enforce for their fees alone.

They will tell you the moon is made of cheese if they think it will make you pay. Have you checked with the Council to see what (if anything) they have done with your payment - if they have forwarded it on and Jacobs have taken a sum for their fees, then you still have an amount outstanding left to pay.

You paid your arrears to the council right?

 

Technically you are liable for the bailiffs fees

 

Morally you have a 50% chance of getting them removed.  Run it past your local councillor and elected head of council.  Explain that you are an OAP, and that you understand that Council Tax is very important, which is why you paid off the arrears, but you are a pensioner on a fixed income and you are being terrified by Bailiffs sending intimidating texts and demanding money with menaces, and you would like the fees cancelled.

Find the councillor details on line, should be email addresses and mobile numbers.
