What if we all put a few pounds in a fund and hire a lawyer to take all the banks to court, to get an injunction preventing them taking charges from all/any of their customers until they can prove their costs.

 

Even if the injunction only cover CAG members it would be good.

 

Any ideas or views for or against?

I would definetley donate to this pot, if someone can confirm wether or not this would actually be possible. Great idea, if workable!

Halifax Prelim letter sent 2/08 Fob off recv'd : 7/08, Settled 17/08, without LBA even being sent : £240 agreed, just £28 short of what we were claiming for!

 

BoS: All statments recieved, totalling £1,680 before intrest, 09/08 CCA Request sent to Hollis Briggs Solicitors, Prelim sent on 12/8. Hollis briggs never did reply to the S.A.R - (Subject Access Request). LBA has been sent, and action has begun in the small claims court! Return date 2/11, Prelim. hearing 9/11. Hollis Briggs have dropped the account, which is now back under BoS head office control! BoS ignored court claim, and din't reply at all. Spoke to rachel Hinchliffe, who said they did not recieve summons, now in her personal hands. 2/11 - Recieved noticed of debt collection on this account from Wescot, just more evidence of icompetency, and for court! :lol:

Regulation 12 of UTCCR says that such an injunction is attainable, but only by certain bodies, of which the OFT is one, the Consumers' Association is another, and CAG is not. Since the OFT is utterly negligent, perhaps it's worth seeing if we can approach the relevant Secretary of State with a view to becoming a qualified body in this respect?

Meagain f the authourties there is such thing as a private prosocution.

Two fatal flaws in the plan there:

 

1. That kicks the standard of proof up to "beyond reasonable doubt", which you know damn well we can't achieve right now. It also wouldn't prevent the bank from continuing to levy the charges in future.

 

2. If your prosecution fails, the bank is off the hook. Permanently.
