    • Thanks @dubai 5 0 I hadn’t seen anyone get emails from the bank to say two agencies had been given the debt to chase and I’ve not heard anything from J&P for ages. I assume IDR had given up so have to see what I get next from them 
    • no you are not. if your exit was not completely clear before you entered the box, you have no appeal, .. end of no get out. esp if you followed another vehicle in when they were not completely clear themselves, the stopping issue is somewhat immaterial and no excuse as it proves your exit was not completely clear for your whole car to exit  if you had to stop. an assumption cars were going to drive clear is guilt.  dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hello new here

can you help

 

i had solicitors letter on behalf of arrow saying they want full payment today or they will take me to court

 

its been over 6 years since i paid off the halifax credit card, yet they saying i have not paid

 

ive moved house since few times so no proof and my post comes on a redirection so they dont know my new address, phone number job or email addresses

i know its a mistake

 

can i ask after 6 years is the claim dropped?

is it no longer enforceable?

 

only got the letter when i got in last night and they only gave me today to contact them

 

well im at work so cant

 

is this scare tactics?

 

had previous debt collection letters from them and wescot,

i ignored them and they gave up

 

now arrow sent solicitors letter and threatening legal action

 

what can i do?

 

i know it was paid years ago but moved house

why did they get in touch now after all this time?

 

is it best to ignore them?

Ring Halifax and enquire what balance has been sold to a DCA considering you paid the balance off on the xxxxxxx.

 

Once you know what this debt is then we can advise further.

not going by the entry under Halifax on your credit file that says 'satisfied' are you. with a balance of £0?

restons are wolves that will take you to court at the drop of a hat if they think they can get away with it on arrows behalf

and against an old address as you've never updated them or Halifax to a move.

 

then you'll have a backdoor CCJ you know nothing about.

 

a judge wont listen at all if you simply keep saying sorry I paid it off without proof.

 

go ring Halifax and ASK!! last payment date and any outstanding balance

they are nothing to do with this now as they've sold it on but must hold the data,

 

please follow the tried and tested methods we know work

instead of coming here asking what to do then questioning each move!!

its nothing to do with Halifax so you can ring and ask them..

its the new owners having your correct details is the important bit.

it will matter not if you've paid it..you wont know to be able to defend it...

 

a claimform or any court documents are rarely redirected

you need to be careful you cant just hide

else before you know it

you've a default judgement you knew nothing about and another 6yrs of stuffed mortgage/any type of credit...
