      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

no not that I am aware of.. I was charged interest every month.

In which case, enter all your account balances in the column which says "ACCOUNT BALANCE AT INTEREST DATE", if the balance is negative then just enter it as a minus figure.....e.g. -200.

You may find that the INTERST CHARGED column and the INTEREST ON PENALTIES columns look the same in most cases, especially if you were overdrawn, don't let this alarm you!!

Sorry for the delay. I think I think I might have cracked it. If at first you don't suceed try and try again. I am Scot by birth so don't hold that against me please. Well I have been on the computer most of the evening. and yes at long last I have managed to do the cag spreadsheet. :D Many thanks to Deler1.

 

At last I have submitted the MCOL and have actually submitted it!!!!!!!!!:p

 

I reckon I should received about £1996.99 eventually from the vultures at the natwest :D

 

I shall no doubt need help, advice and support in the next few weeks or maybe even longer according to some threads

Thanks Natwestmember, Your advise on Adv Gold fees helped me to understand what I could actually claim, so thanks very much. I really was confused and would have tried to claim too much. At the moment I am feeling pretty confident, but suffering from the frequent moaning from the family for being on the computer most of the time!!!!!

I've had to fight off children on runescape and my Husband with his photography,to get hold of this laptop. The computor is bust!!!! but I won as you can see. This site is a bit addictive. I seem to be looking a my thread to see if I've had any responses. Thanks for all your help. The cag spreadsheet was quite simple after your help. I felt a great sense of power when I hit the submit button on the MCOL, but I suppose the tension starts now. But I feel I am prepared for the fight. It is only right that I should have my money not them. I had to work hard for it. The less I had the more they took. I love mutiny against the system and its brillant that everybody is fighting the powers that be.

 

I'm a great believer in good things will come for those that wait.

Hello, Got my first letter from the court today. The notice of issue. The bank has until the 27th January to file a defence. Is it worth writing to the bank and telling them that first schedule of charges were inaccurate. I had realised they were wrong. I had claimed to much interest. Do send Mr Higgly the amended version with a letter explaining the first schedule of charged were infact wrong. Or do I wait till I hear from the solicitors.

Sorry for the late response Sandra, but what with the situation going on in my life at present I havn't had much time on my hands, Ive pm'd you the details.

Firstly have you sent the copy of your schedule to the court? If you haven't then send with the cover letter. Then it's probably best to wait for the acknowledgement of service, your claim will be out of Mr Higley's hands and more than likely be passed on to Cobbetts you can then forward any correspondance to them.

I'll keep watching.

Hello everybody,

 

I think I have gone quite mad. I am now on a mission with credit cards and the ppi on loans. I am horrified that I have just sat back and let these organizations take my money that I have worked hard for,

 

The natwest have rung me 3 times this week about my overdraft. Different people asking me about the same thing..2 calls on Friday and one on Saturday. They begger belief. I have mentioned the word harassment to them. so lets see if they stop.

 

Today I have sent 3 SAR to the natwest loans, abbey loan and m&s loan,

lets wait and see what they will give me. I thinks a lot me people will be claiming back their ppi for them being mislead by these organisations after the prog with Trevor McDonald (Saint).

 

WOOeeee!!!! Let the fight begin.:x :x :-x :-x

Hello, I have just received confirmation from MCOL that the bank has acknowledged by claim. They now have 28days from the 13th Jan, so that will take till the 10th Feb. So here we go. Will probabley post for help and advice please.

The ball is well and truely rolling now Sandra. You should expect them to wait right up until 10th Feb before they enter their defence, this is typically normal of Nat West so don't worry if you don't hear anything between now and then. You now where we are if you need us!! ;)

Hello all,

 

Still waiting for any response from cobetts, but they have another week. What should I be doing now? Should I be preparing my court bundle? or wait till they put in their defence. The schedule of charges I sent with my prelimary letter and lba I had to amend. I did send the court the amended version. It was actually a little less than the one I sent with the prel and lba. Do I wait to hear from cobbetts and send them the amended version or send it to the bank???????

Just sit tight for now Sandra and wait for Cobbetts to submit their defence, you've got plenty of time to prepare your court bundle (should you need it).
