    • No i decided I would try and keep paying this down as best I possibly could and have paid over 35k off of the total amount. It’s been hard as hell tbh but just seems too much to do with the prospect of job disruption looking. the issue I have with pro rats is the credit file is trashed anyhow like you are defaulted anyhow is it not? I am willing to trash it for 6 years if needs must but having it trashed for over a decade seems crazy. This is the dilemma I am in

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have sent my SAR (subject access request) on the 26/10/06.:lol:

 

I have counted up charges of statements for past 4 years:lol: and so far i am owed £544 :mad: the 2 years i dont have 2000/2002 were 2 bad years and i reckon at least another £300 in charges:mad:

 

 

If you have a quick ? that you need answered I found the chat room very helpful.

thanks stitch for your reply:cry: . I have already sent my SAR. (Subjest Access Request) so no need to estimate.

 

As the years 2000/2002 were really bad i will wait to get the statements.

 

Could maybe be owed £1000's (i wish).

I would like to have the nerve not to sign but i think i would be afraid not to get money back:mad:

I havent received a confirmation letter form the ulster. Do you know if they leave you to the last minute???:confused:

ok stacy. when are your 40 days up? if you are sure they have recieved your S.A,R then they should reply before then. did you ring and ask about it?. you wouldnt want to wait just for them to say they never recieved it.

yes i have just today recieved a very polite letter from the ulster. Stating they will have quite a bit of work to compile all the statements.

 

They said that they will have all the statements back by the time peroid ive given them(40 days which is up on the 7dec).

 

Oh yeah and they want me to know that i should not hesitate to telephone there manager:rolleyes: re anything to do with charges to my account:rolleyes: .

 

No way am i ringing them ill just send the next template letter im not getting into any conversations were they can blind me with "facts" and "figures".

I was sent a letter from the ulster saying that my account number was wrong. I have had a few account numbers over the years im sure of the one they say is wrong.

 

I reckon there going to say they cant trace my statements if im not sure about account number but i know that they can give me statements on all my banking history.

 

anyone got any advise.:o

yes i have just modified the S.A.R letter and not included any account numbers so they will have to send them all.

 

I dont know weather this is wright but i have given them 40 days in which to comply from the original date and they only have about 10 days left to reply.

 

Would that be correct

i have just recieved a letter form the ulster saying that they have the statements ready for collection at the branch i was thinking would it be a good idea to not accept them until they have all the statements.

 

They may think that im going to accept that but i know that the other statements contain loads of charges and they dont want to give those out.:mad:

Bank has just sent letterto say 1 set of statments are ready for collection but i dont know weather to get them or i could split them into two different claims:confused:

hi bally 35, yes please pm us if you have in any info that would help this site and our knowledge of how the banks work.

 

The reason i have had so many different accounts is for exactally the reasons you have listed. Joint account then becoming single account then changing to ufirst etc etc. i know someone who worked there she didnt even know the bank charges were unfair but that was a while ago. Im so cross when i think of a fella in my local branch who i thought was decent and he said unfortunatley:mad: that my charges were necessary i actually was left feeling like a criminal for going over in the first place :o

I sent off my list of charges letter and they totaled £627. I have now recieved a letter back from the ulster, they say there charges are fair bla bla bla:mad: they have given me a £90 into my account as 'goodwill' .

 

Im not sure what letter to send now could anyone help????

Thanks for advice i have just sent off the letter saying i will except the £90 as an interim payment but will be pursuing them for the remainder. Will i go ahead and sent the LBA letter or should i wait on a reply to that letter??:D

How long has this all taken as I have just sent first letter requesting statements. Hope things move quickly as they have already taken close to £600 in 3 months mostly referral fees £90 EACH MONTH. I am totally disgusted as its this that is putting me over my overdraft limit. I hope you get your response soon and a huge cheque!!!

I think has taken about from nov06 to get this far. I am no not sure wether i will go ahead i had just went to the N Ireland court online file cliam and could'nt reg with them. As i was waiting to reg with them i recieved newsletter from Martins money savings and it said that new legislation was coming out in April and the charges were going to be set. The charges were going to be set at around £11 and only the difference wuold be paid i have a lot of £11 charges and i dont think i would end up with enouogh money to make it worth my while.

 

 

Im not sure however if this applies to banks in N Ireland?

 

It sounds like your charges are above that by a great deal:mad: SO ANNOYING... Get your money back it is yours but i think as i have already got £90 back i would only be due about £100 I suppose this is better off in my pocket than there's ummm I will go after all you have talked me into it:lol: im a nutter i know. No i think I will you have caused e to rethink here. Will keep this updated so watch out to see how get on i would love the whole £600 im owed but think the £11 will cancel a great deal of these.

Defo need to get out more :lol:

just got more charges from the A&L £100 for going £2. OD im near sick rang them they were so blasey if thats how you spell that word. Im rippin. :mad:
