    • If that was the reason then that is good news. The whole reason that being able to charge £100 for breaching private car park rules is because the law Lords decided in a celebrated case that the rogues had a legitimate interest in keeping their car park spaces available for all motorists . {parking Eye v Beavis]. However when the business is closed then there is no legitimate interest in keeping spaces free so to charge £100 is a penalty. As such any Court would automatically throw out the case when the penalty charge is accepted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry to post anothre new thread on this but am really worried now..

 

Have papers lodged aainst nationwide, and so they will close my account once I get my money bac.

 

I don't seem to be able to open a new account.

 

I ahve bad credit history and the banks that are already out of the game are Halifax and A & L. Also live in NI so can't get a natwest or many other only mainland accounts.

 

Applied for an Abbey account, got turned down. And have rung most of the others co-op, HSBC etc to see if they credit score basic bank accounts and they sdo, so basically I wouldn't get one.

 

Looks like I may have to cancel my claim against nationwide here as I need an account to pay my wages into which come by cheque so internet banking only isn't really an option. Also need to ahve direct debits and standing orders set up for various things.

 

REALLY would love any advice help or anything right now :(

 

Have really read anything I can online and here for help and going round in circles with no's all round.

 

Don't want to keep applying for accounts and being told no as going to make credit score even worse (if possible!)

Have you tried RBS they do a basic account with no checks. I even managed to get one. Not sure bout you being in NI but worth a try

Trouble is, as a student 10 years ago and after I did the silly thing of getting too many credit cards and getting myself inot a mess. Been paying it all back for last 5 years threough payplan. But if I open an account linked to a credit card I am still paying off they might freeze the account :(

 

RBS, halifax, BOS, Tesco all on that list...getting there only another year or so to pay a ridiculous amount of money back. But this is what is annoying I am trying my best, actually earn a good wage and can't open even a basic account now..

Bank of Ireland basic cash account will only refuse your application if you areUndischarged bankrupt or have a record of fraud. Alos may close your account if a DD is refused 3 tiimes

My concern about that table which I ahve studied till my eyes ar sore is that it says that next to Abbey too, and why are they doing credit scoring with HSBC and others that I rang if it is only fraud or bankrupcy they are looking for :o/

 

The NI banks ahve a really bad record too.

I know how you feel I went through several banks before one would accept my application and that was for a basic cash card account at RBS.

A credit check is not only to score your rating but also turns up any instances of fraud or bankruptcy, therefore they can run a check for the purpose of detecting fraud etc without relying upon your credit score to determine whether you get accepted for an account.

 

Dont know anything bout the bad record of NI banks but in my experience they're all money grabbing w*nkers who are all going straight to hell, IMO.

The key thing for you, much as I hate to say it is to get an account and make sure Nothing bounces, at least until you get your credit rating sorted out so if tht means going with an NI bank then that may be what you have to do. Still im by no means an expert and preach far better than I practice so am sure someone else may have better advise
