  2. I've had a couple of over limit fees on the account since my claim went in. Should I ring them and ask for them back? Or just let them go?

But yes just checked my online account and they have refunded the £580 odd in full, charges, interst and court cost. They did it yesterday, I've had no letters from them yet! I putin the small cliams thing at the end of June - but becuase of a couple of errors (by court and me) it didn't get registered until the 1st Aug - after the OFT ruling I believe. I am in total shock!
  4. Well it has taken me until now to finally get round to submitting my papers to Capital One. So hopefully I will ahve this one done and cleared int he next couple of weeks!
  5. To answer your question btw - I think they ususally say in the letter that overdraft needs to be paid back in those 30 days. But obvoulsy if it is big overdraft they may well agree to a payment plan to pay it off. Your friend would need to contact them and check it out thoguh.
  6. I still haven't recieved a letter and got my settlement a month ago - it is realy odd as I don't know anyone else who hasn't. Kinda still think it is a slip up on NW side and it will arrive eventually...
  7. Mine hasn't been closed either...not sure if it is going to be was settled the 15th and still haven't received a letter. Not sure if I sure ask if it is going to be closed or just keep quiet ...
  8. Got my settlement from NAtionwide a couple of weeks ago - still not had a letter about account closure. Just wondering if they have stopped closing them, or they are taking their time with the letter. Anyone else won recently and either had a letter or not? Cheers
  9. I had the same situation with capital one, loads of calls from them. I got them stopped by writing to them, it took a couple of goes. I was paying back what I could afford a month with them but they wanted more. Tough I didn't have it and I was making payments of what I could. This is the key, even if it is a very small payment agree and stick to it and then they can't do a lot as you are making some effort to repay it. PM me if you want copies of my letters too, I can email them to you. I know it is horrible getting the calls all the time and makes you feel rubbish fighting with them over if you are going to give your date of birth etc, but once I wrote the letter with the facts in it I began to feel empowered about it all.   10. Phoned on Saturday and asked where the £60 was - it was credited later that day All done and dusted now. Still haven't had my letter of closure through, keeping silent hope that it might not come as no luck with a parachute account yet! Thanks again for all the help and advice people. DPA going to Halifax tomorrow.....Will file small claim against Capital one in new year if not befoe
  11. Just checked my account and suprise suprise they haven't refunded the £60 Phone call tomorrow morning I think ...
  12. Spoke tothe nice man again today - he said they will refund the £60 if it wasn't included in the other refund (it wasn't) as to save them court costs... So I'll be watching my internet banking again for a few days to see it appears back ...
  13. Mine was just over a week from when they got it till they paid it. I did it through the courts though not online...
  14. Well email was read and ignored, phoned the Customer Service manager who sent the letter to me saying charges were being refunded. Very nice fella actually. But he isn't sure if they can refund the £60, says that probably I will ahve to submit the court papers again for it. He agreed it was total silly as it will cost them another £65 on top of charges to refund to me, but explained that they are now locked up in 'procedures' He is going to check with their legal department on Monday and get back to me. Hmmmm...
  15. Going to submit court papers tomorrow Just got £600 back from nationwide! Anyone rought idea if capital one are being quick with returning fees once papers are served? Wondering if I will see the money before Christmas!
