    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi all

first post so forgive me if its in the wrong place

 

i am after some advice

 

10 year ago my house was repo'd due to marraige break up

 

i had short fall to pay

the house was in joint names

 

ive been paying each and every month since but got to thinking just how much ive paid

because i dont think the ex is paying any of it

 

i contacted fairfax who are the account managers

there have been a few others before them

i asked them for a list of every payment made by me to this account

 

after letter after letter i finaly got a list of payments since they took over (aprrox 2 yrs)

 

i then asked them to provide a full list of every payment from the beginning and

after 8 weeks of waiting i got a letter saying that they had got a reply from global arrow

stating that the information i want is unavailable

 

i find this very hard to believe as far as i am concerned i shoukld be able to get a statement of account

 

 

any body got any advice on this any help would be helpful

hi dx100uk

just been looking through some papers and

 

 

the mortgage was like i said by Bradford and bingley and the lender was mortgage express

 

but now globle arrow some how are involved

 

the only reason ive been digging is yes i know i owe this money

 

the debt is x amount and ive been paying and its a joint debt but i don't think the ex wife has been paying any of if

 

as far as im concerned i am only intending to pay half so that's why ive been trying to find out exactly

how much ive paid over the years this way i may look at asking if they will take a lump sum if this makes sense

 

but both faifax and arrow seem to be keeping tight lipped and very un helpful

who is/was stated as arrows/drydens 'client' in their letters.

so sadly they can mug you for the lot.

 

 

but something smells here.

 

 

have you ever had a letter called a notice of assignment

whats the notice of assignment letter and fairfax it letters saying they reveiw payments every 6 months and keep track of my payments to them

 

 

not had any letters from arrow

 

 

the fairfax letters state arrow as there client and the address of the mortaged house

you have a mortgage shortfall

the debt has been sold to arrow global by the looks of things

 

IMHO you are being cash cowed.

 

so time to resit the whole debt.

 

how and why did you start paying arrows on this

 

we'll need the full history with dates.

cant remeber off the top of my head

 

 

but been paying it for over 10 yr

 

 

dont want to say short fall amount

 

 

but been paying £50 pm

 

 

fairfax sent me a letter about 8mth ago saying that arrow had said if i paid £9000 then they would wipe the rest

 

 

then after that i stated trying to find out how much i had paid

 

 

thats when i got the brick wall treatment from fairfax and arrow
