HFC, no statements so claim rejected, now found them

Hi

I have been looking around at all the PPI claims and l decided to look through some old banking stuff.

 

I found an old HFC account that l had the agreement for, and the closing statement for it.

 

I filled in the FOS questionnaire and have sent in the copies of the application and the closing statement.

 

This is from 1993 1994 so l do not have any bank statements but the last statement does show that l had use of a limit of £7500 for that year.

 

The original agreement was filled in by the guy in the bank,

he ticked the PPI box in a blue pen and l signed with a black pen.

 

I did not need PPI, it was sold as a must have !!

 

HFC have refused my claim as they say try cannot tell how much PPI l had paid??

 

Do l need to SAR them??

 

I shouldn't have to,,they should have it all.

 

Just seems like they are avoiding paying.

 

They have said l can go to the FOS?

No leaflet included in their letter.

 

What is my best course of action, SAR or FOS complaint.

We have know HFC to provide statements/transaction history back as far as 1989/90.

 

When was this account closed?

 

They may have destroyed the account details after six years of the account closure.

 

In principle you should be able to claim the ppi back providing there are records as to how much you paid.

The HFC Current Account Plus was a revolving credit agreement where by you were given a credit limit which you could use. Similar to a credit card but you had a cheque book with it.

 

The amount of PPI paid would have been dependent on the balance on the account from time to time and would have been applied to the account monthly.

 

In order to work out how much PPI was paid you would need all of the statements so you could try a SAR but whether they have the transaction history is another matter.

Yes l think l will SAR them and get all the data.

The limit was used as l did use it for a reason, when l repaid it it was at the limit.

The GM card was passed on to someone else,

This was mis sold on the basis l never asked for it. It has the salesman's pen tick not mine. I signed in one colour, he did everything else in his pen. Also l did not need it. I have not got the PPI booklet but from others that l have l can see that l would have been excluded because of other reasons!!

Yes, complain to the FOS? They have said that they cannot work out how much l have paid as l have failed to provide them with statements?? They have stopped short of saying that they do not have any, just that they cannot do anything unless l provide them with said statements??

All very strange.

Hi,

 

 

I put in a claim for a rebate of PPI on an old HFC loan account that l had with HFC Bank for just about a year, back in 1992 /1993.

 

 

I then sent it off to the FOS when HFC rejected it.

 

 

HFC said that they had no statements and that the only one that l could produce showed a closing PPI payment for the last couple of days of 69p

so they offered that and the FOS said that is all they could do.

 

 

That decision was last year, and l just sucked it up

 

 

I have been helping my dad out at home who has just retired, and for some reason some of my corries are in his house???

Including a full set of statements for this account, showing nearly £400 worth of PPI paid.

 

 

I am making the claim because it was ticked by the HFC salesman who said that l had to have it,

and also my empolyment status would have imvalidated any claim.

 

 

So l have sent it off to HFC with a covering letter asking them to reconsider,

particularly in light of their original offer of repayment,

albeit only the 69p l could prove.Is it too late??

Well yes it is too late to ask whether it's too late cos you've already sent it off. But as it happens, no it's not too late to reclaim.

 

Hope you read up on here about calculation basis or you could end up still missing out.

 

In future it would probably be a good idea to take advice before making complaints / queries, rather than after.

cups, did you complete a spread sheet so you know how much you should be receiving back ?

 

Please tell me that you did NOT send them the original statements - only copies ?
