      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

A few weeks ago I received a letter from Halifax telling me they believed they MAY have mis sold me PPI on my credit card because I am self employed and I would not of been eligible.

 

My first reaction was to think it was a [problem] mail, as I do not have PPI so I rang the bank directly (ignoring the telephone number on the letter) to verify the letter who advised me they would never send letters out inviting me to claim and it was indeed a [problem] and to disregard the letter.

 

I then noticed that the pre paid envelope enclosed was addressed to the banks address in Leeds where I have sent them letters before so I googled the address and the address matched exactly the address the bank use.

 

So I called again and directly asked the question do I have PPI. They advised me I do not and have never had it. They then transferred me to another department who advised me I do have PPI. I was pretty shocked as nowhere on any of my statements does it even mention anything about PPI.

 

I made another call to the banks main number and again asked but they said I don't have PPI.

 

Anyway, I filled in the claim form, only adding my name, address, account number and ticking the box that I am self employed. I left the rest of the form blank.

 

I have now received compensation for being missold PPI (only 400 quid) but what is really bugging me is the bank say I don't have PPI while the PPI department says I do.

 

I askd for it to be cancelled only to be told I don't have it to cancel. I honestly don't know who to believe.

 

Has anyone else experienced this?

I had a similar letter and sent the questionnaire back, I'm waiting to hear from them at present. I also did a SAR and that shows that I did have PPI, copy statements confirmed the repayment cover was being taken, yet the box for 'Credit Card Repayments Cover' was not ticked ! Neither was 'Card Care', yet that was taken as well...

 

I'm waiting to hear their excuses. In the meantime I've compile a list of charges they made and am sending that to them for repayment...

I have spent an hour on the phone this morning trying to find out more information about when I had PPI. I have finally been given the dates of 5/2/07 to 16/5/08.

 

In the letter regarding my refund it mentions my current balance now and the difference if I did not have PPI. I am not 100% sure but are they using recent statement data to guess what I am owed? I don't have debt with them now and the balance is paid off in full every month but back in the early days I racked up quite a lot of debt with them.

 

I asked them to send me copies of my statements from 07 and 08. They want to charge 70 quid!!

 

I told them not to bother and will file a SAR.

 

So does anyone else know how they work out what you are owed? Is it based on actual data or do they just guess to save time?

First rule of CAG - do not discuss these matters on the phone. They may say something and then deny it later. Everything in writing is the safest way, they can't deny it if you have it in black and white.

 

It's not a guess, they have to work to a formula and should give you a breakdown of the figures they used and arrived at. The links in post #3 above from dx100uk take you to explanations and spreadsheets you can use to work it out yourself.

 

With any claim, it's usually worthwhile doing a SAR at the start so you have copies of the same data they will be using. Much cheaper than asking for copy statements.
