They have no right to refuse it.

 

Best to take a payment slip into a branch and to pay it over the counter.

Keep all records and keep on doing that.

She had no assets and is on a zero hour contract and I'm trying to help her with her debts. Tempted to write to themon her behalf to advise them that if they took her to court, the DJ wouldn't be impressed with them refusing direct payments.

They won't care about your letter.

 

If she has been paying via the internet, why can't she keep on doing that?

I'm guessing that the credit card has been closed?

 

If so, the payment would have been automatically rejected/returned because the credit card is closed.

 

The debt accumulated on the card still exists but you can't make payments towards it in the same way as if the account was still open.

Hmm just a question

Did she have any credit card charges applied to the account at any time eg Overlimit or Late payment fees?

I asked them to send me a 12 month statement of account showing all transactions in the year running up to default\when she had to stop using it. I think it had a few late payment charges on there, I'll have to check (2012).

Might be a good idea to do a full SAR request and do the £10 fee asking for everything. There are good templates available on this site. Then read some of the threads about claiming back credit card charges (even beyond 6 years)

 

Just to be clear is the santander debt a credit card debt or is it something else?

 

If the debt in the OP is a credit card debt then by beginning the reclaim process you will put the account in dispute. Depending on how old the charges are and how many the claim may even wipe the balance making the DCA irrelivent in this case all together

Its a credit card and I've only got statements for 2012 when I thing charges stopped. Will check with noddle for details of when the account started before I advise on a SAR. However looking at the 2012 charges, they won't wipe out the debt but it may be worth it to slow down collection activity.

Thats cool. The older the charges are the more they become worth to her as she will have several options when claiming them back to add interest to your claim.

Any charges added to your balance have had compounded interest charged of which you have the right to claim back also.

Below is a Barclaycard thread re: credit card charges.

Different bank so it may respond differently but the laws used to justify the claim are still valid and accurate.

 

If your daughter gets a full SAR *and* keep anything else that gets communicated to you then you will then have the infomation you need to make the right decisions.

 

If you need time to think and prepare a claim, you could have your daughter do a CCA request.

Other thing is avoid talking to them by phone. You will need everything in writing.

I agree with this, sounds most likely the account is closed/frozen but the debt is still outstanding of course...So it remains 'open' for the purpose of showing the debt but not for processing any transactions directly...This is why you can see still it in places like Noddle as open or in default or whatever it says...

My daughter had the same problems with Santander and Freds. I write a letter of complaint and they said it wasnt closed or frozen, they were just returning it because they wanted her to pay Freds. Wrote to them again advising that she would only pay them and if they kept returning the payment it was their problem. Also pointed out that if they took her to court she had no assets and was on a zero hour contract and it wouldn't look good that they weren't mitigating their loss.

 

They wrote back and said she could continue via internet banking directly to them
