I am currently on Orange.Last week phones 4 u gave me a call & we agreed a new upgrade to the EE network.They haven't given me a date to when i will be receiving my new phone & sim card.Today it has been a week since we agreed however i rang them today & told them i want to cancel.They said that i couldn't cancel.I find this unbelievable as i have not yet received the the phone or used the phone.Surely this isn't correct.Also i still don't have confirmation on when i will be receiving the phone.:-x

Welcome to CAG

 

Sent them an email. Tell them that 'under the Distance Selling Regulations (2000) my right to cancel an order starts the moment you place your order and doesn’t end until seven working days from the day after you receive your goods.' Tell them you will take matters further, if the order isn't cancelled.

 

Include the order reference number:-

This is the email i have just sent them.

 

On 26/03/2014 I placed an order for a HTC One M8. On 02/04/2014 I spoke to one your customer services adviser stating that I wished to cancel the order, but you have refused to accept this cancellation.

I have not yet received my Phone or sim card & still haven't been given a date on when i will receive the goods.

 

 

The Consumer Protection (Distance Selling) Regulations 2000 give me seven working days starting the day after I receive the goods to cancel.

I cancelled within this timeframe and the above regulations state that I am entitled to a full refund no later than 30 days from the date of my cancellation.

Accordingly, I look forward to receiving confirmation that my order has been cancelled.

 

 

 

If I do not receive within 5 working days from the date of this letter, then I shall commence court action with no further reference to you.

Yours faithfully,
