are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

did you get yr defence in on time?

maybe wait to see if they inform the court whether they will be continuing or not with the claim (they have 28 days from receipt of yr defence to decide either way)

if they don't notify the court either way accordingly, it will be auto stayed.

Hi

 

yes I got my Defence in on time.

 

they sent me a copy of an application, i wanted to know if that meets the requirement of a credit agreement under CCA 1974.

i have attached a copy in post 22

that's is an application form.

NOT a CCA under the CCA

As i understand it the statute Barred clock stops as soon as a Civil Claim has been issued. Does it still remain suspended (stopped) after a Claim has been "Stayed"

 

Yes...the clock only restarts if they discontinue or you successfully strike out their claim.
