My OH's dad got into some financial difficulties after an accident and he is unable to work.

 

The bank, either HSBC or Abbey - can't remember which, closed his account but are still putting penalty charges onto it.

 

Are they allowed to do this?

They will continue until you challange it. Inform them that you consider the account to be in dispute, this should stop the placing charges on the account. Also start proceedings to reclaim these illegal charges.
