It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OMG £1900/- against the ODI claim received.

 

This is excellent, thanks for all your help. I will post my success on the successful claims thread on this forum mentioning all the people that helped me here.

 

I am thinking of sending the following letter about my 'Gesture of Goodwilled' Barclays Additions Account too.

Dear Sir/Madam,

 

Ref: xxxxxx

Sub : Barclays Additions Account

 

I opened a current account with you in March 1996 at which time, I was sold your Barclays Additions Account.

 

I believe I was mis-sold this packaged bank account. I was not given the option to opt out of this sort of a package. The Financial Services Authority's advice to consumers is that it is not compulsory for an account holder to hold a packaged account. Additions Account, therefore, was clearly mis-sold to me, hence, I request a full refund of all the fees that I have paid so far, plus interest.

 

Please find enclosed herewith my completed FOS Consumer Questionnaire which together with this letter, lodges a formal mis-selling complaint with you.

 

Please investigate my complaint within the eight weeks allowed to you before the matter can be referred to the Financial Ombudsman.

My questions are as follows ...

 

1. Does this really need a duly filled PPI Questionnaire? This is not a PPI case yet, Additions is actually a bunch of covers I believe charged as not premiums but cleverly called 'Fee' in the statements.

 

2. Is there anything I have written here that is not actually the case, for ex. me stating that "The Financial Services Authority's advice to consumers is that it is not compulsory for an account holder to hold a packaged account"?

 

3. Should this be addressed to their PPI Dept. at the above address?

 

Please scan my letter and advise.

I'm glad I was proved right about going back to them despite the refund years ago. If you can manage a Site Donation, it'll help us keep helping others, and thanks.

 

Re the subject of Additions fees, you cannot reclaim them in the same way as PPI and a PPI Questionnaire is not appropriate.

 

As you knew about the Additions status on your a/c, then I don't see that you'll get any further refund after what they repaid in 2007. You can't use the same arguments as you would with PPI.

 

In my opinion, pursuing this may get you nothing ................

Yes that was an excellent guess and you are probably right about the Additions too. But now I am becoming a bit greedy now that I have received all these refunds :smile: So nothing ventured nothing gained, keeping your advice in mind I will not keep my hopes high but will still give it a shot. Good thing is that I have all my statements from the past. Here is a letter I have drafted, please could you take a moment and help me edit it?

 

Dear Sir/Madam,

 

I have held an account with you since March 1996 but in September 1996 this account was automatically upgraded to Additions Account at your end without my permission. It has come to my notice that this contained a number of insurances automatically sold to me without my expressed permission. I did not need or use any of the insurance or non-insurance benefits of this packaged account.

 

I believe I was mis-sold this packaged bank account. I was not given the option to opt in or out of this sort of a package. The Financial Services Authority's advice to consumers is that it is not compulsory for an account holder to buy such covers when opening or holding a bank account. Additions Account, therefore, was clearly mis-sold to me, hence, I request a full refund of all the fees that I have paid so far, plus interest, deducting the previous amount paid by yourself exhibiting a Gesture of Goodwill in 2007.

 

This letter lodges a formal mis-selling complaint with you.

By all means, go for it if you want to try.

Then in post #18 you say, "I have held an account with you since March 1996 but in September 1996 this account was automatically upgraded to Additions Account at your end without my permission."

 

These are two very different scenarios and perhaps you should first tell us which is closer to what happened.

 

If you can avoid it, I would not complain on the basis that the product was mis-sold. To my mind, the far stronger argument with Additions is that it was applied to your a/c without your knowledge or approval.

 

Yes, they may well come back and say you should have argued about the amount of the refund back in 2007. But, nothing ventured, nothing gained.

 

Redraft the letter and put it back here for our consideration.

Yes, the letter in the post no. 16 is not correct. I checked my bank statements and corrected it accordingly in the post no. 18. I think, I in a hurry had cut and pasted from my ODI complaint letter :(

 

The bank upgraded my account in Sep 1996 according to my statements.

 

Your point is very valid and I am going to approach it from the 'lack of permission' angle rather than a mis-sale.

 

Please just one more time, could you read the fresh draft and give me a green signal so I could post this tomorrow.

 

Oh and I will love to donate to this kind site, glad you pointed out. I had almost overlooked that in my excitement lol. Also, I am no expert and can not offer any advice to those looking for help with their PPI claims and would rather not cause any confusion on people's threads but, I am sure you people could do with some other kind of helping hand. Say technical help or site maintenance or typing out templates etc. Please let me know if I could be of any use.

I refer to my current account no. xxxx xxxx, opened with you in March 1996. In September 1996, the bank upgraded the account to Additions status without my knowledge or permission, whereby I incurred monthly fees on an account that was previously free.

 

The Additions status gave me no benefit or product that I either wanted or needed.

 

This matter was only partially addressed in 2007 when the bank made a partial refund of £290. However, it is only now that I realise the bank should have refunded the full amount to me, and that I was treated unfairly at that time.

 

In the circumstances, I now require that you refund the full balance of Additions fees that you took from me.

 

Please respond fully within 14 days.

Thanks a bunch for drafting the letter for me :)

 

Referring back to Post no. 12 in this thread where I was trying to reclaim 'Gesture of Goodwilled' ODI charges ...

 

And as post no. 16 shows, Barclays refunded some £1900/- against the ODI. Success!! I am attaching the break-up they sent via post today.

You gave them honest info about the previous claim and who knows if they've taken this into a/c in the recent calculations.

Posted the complaint letter on the 23rd of Jan. 2013.

 

I received a text message and a letter last week that gave me a Ref. no. that I can use on their Trackit service to see what is happening to my claim.

£1126/- refunded. They will send me the break-up later.

 

Roughly ...

 

Refund = £800

Minus Previous Refund £300 = £500 (approx. figures)

Plus 8% Interest £500 = £1000

Plus Gesture of Goodwill £50 = £1050

Just made another small donation as promised earlier. Thanks for all your help and support.

 

I am planning to now start a claim on all Unfair Charges by Barclays so far and am utterly confused. Have read all over the forum yet am unsure which statement entries were unfair.

 

Right now I need to know if I can claim

 

1. Monthly Usage Fees

 

and

 

2. Overdraft Fees

If the monthly usage fee relates to use of the Barclays Personal Reserve system, they're unlikely to refund unless a claim is made using the Financial Difficulty route.

 

Same for Overdraft Fees.

 

Over what period are you looking to reclaim.

I was not in particular Financial Difficulties at that time but was going deeper into serious debt. My husband was and is still in full time employment. Just that our debts kept mounting till we had to re-motrgage our home in 2007. When I see my old statements I only see bills and bank fees and interests and credit card atm withdrawls. We never could spend the money on ourselves ever since we took our first £5k personal loan from Barclays in 1997 and then another loan for our car in 1999. That was the end. We never recovered from a debt that kept mounting.

 

Yes the charges were applied every time my a/c went into red.
