Yes just quote the relevant CPR PD (3 in this case) that you are making the application under and requesting an order the court compels they comply with the court directions dated xxxxx or strike out the claimants statement of case of their own initiative.

I already have an order in with Court for them to disclose all docs in POC to be heard same time as hearing, which is on 24th, is it prudent to file new one for their witness statement or leave it to the unless order to be heard

3A.1 If a claim is referred to the Mediation Service pursuant to rule 26.4A or at the court’s direction, the settlement agreement must be in Form N182.
