    • The Barclay Card conditions is complete. There was only 3 pages. This had old address on. Full CCA. 15 pages. The only personal info is my name and address. Current Address The rest just like a generic document.  Barclays CCA 260424.pdf
    • An update to this case as I’ve not been on in a while.    I am still awaiting a charging decision in the case. The two police officers involved have said their personal belief is a section 47 ABH charge is the most likely outcome but this isn’t a sure thing of course.    The EA certificate from the issuing court has now lapsed. The court have refused to recertify him until they’ve had a hearing in to the case, and the district judge has issued orders to surrender all evidence, footage, photos etc.    I have done so promptly.    the EA, not so much . Equita have claimed they cannot provide his bodycam footage as the camera he was wearing is the EA personal one not one of theirs.   the EA has claimed he has asked Equita and the police for the footage as he claims he doesn’t have it.    the police have confirmed they didn’t seize his camera and they don’t have it.    so they are basically pointing the finger at each other all the while failing to comply with the district judges order to provide all evidence they intend to rely on at the rescheduled hearing.    The district judge has stated the hearing for his certification will NOT be the hearing for my complaint as there is no charge as of yet, and just as to whether he should be recertified or not.    I’m not 100% on why that can’t be done at the time, but I’m not about to question a judge…..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there just after some advice please.

 

On the 30th June I had to cancel our car insurance direct debit

since 3 payday loans had used all the funds in our account and I knew if I didn't then that would mean £50 in returned direct debit fees.

 

I then received a letter saying that because the direct debit had been returned with them,

a £12 admin fee had been charged (note this is all x2 since my husbands policy is with them). I

 

emailed straight away trying to get the £12 x 2 "administration fees - sending out a letter)

saying the bank had cancelled the direct debit in error (a fib I know). I

 

asked if they could refund the fee and asked to reset up the direct debit for payment on the 15th

(when husbands salary went in) instead of previously on the 5th.

 

4 days later, I received an email reply, refusing to refund the £12 fees and that £31.73 (direct debit + fee)

would be taken on the 5th.

 

I replied immediately saying I would have to cancel the direct debit again

since I knew there would be insufficient funds to make payment. I

asked why they would not consider moving the direct debit to the 15th.

 

There was no reply.

 

I emailed again on 21st July asking to reset up the direct debit for the 26th Monthly and arrange to pay the fee separately.

They responded on the 22nd July asking me to confirm address, postcode and date of birth.

 

By this time, I was engrossed in pursuing the PDL companies and so did not reply.

 

On 16th August I received a letter demanding full payment immediately

- the debt had now increased to £84.56 for my husbands and £82.25 for mine (

presumably the next months payments as well).

 

In my emails I said I would cancel the policy.

I cancelled the direct debits and moved our car insurance elsewhere.

I emailed immediately back to them and asked for a full breakdown of how the amounts had been calculated.

I also explained that as we were now in severe financial difficulty

I could not afford to pay in one go and offered to send a full I&E to confirm this.

No reply was received.

 

Now we have received a letter from Collections at AA saying despite requests for payment

the balance remains unpaid and f payment wasn't received our file will be passed to a debit collection agency.

 

However they have renewed our insurance with them for the coming year! Documents were received on 22 August.

 

In the meantime, we had insured our car elsewhere and

 

this morning I have received from my husbands new insurers that they have received correspondence

from another car insurance company that his car is still insured with them

and it is an offence to hold dual insurance on any vehicle.

 

Is there anything I can do as I dont think they have been very helpful in my requests?

firstly

DCA's are NOT BAILIFFS

they have NO SUCH LEGAL BAILIFF POWERS.

 

as to whatever they threaten, take with a VERY large pinch of salt.

 

tell the AA you did not ask nor give permission for the renewal

cancel it

 

so, when was the lasttime they got money from you

 

if you cancelled the old policy, then they have no right to renew.

 

its p'haps also better to WRITE to them

rather than email

 

it appears they are getting lost.

If you are paying insurance premiums by instalment, the amount you are paying each month is to pay for the instalment plan you have entered into (often this is a credit agreement) that has paid the premium IN FULL to the insurer. I believe the AA may act as a 'broker'.

 

So if you cancel early the balance becomes due.

Think Brig is right on this one, most policy's offer a refund if cancelled but after a certain number of months this is 0. You can cancel (probably with an admin fee) but you lose any remainder.

Did this a few months ago to get the proof of ncb as it was cheaper than changing vehicle with my existing insurer.

 

I am wondering though what proof of ncd you used with the new insurer, if the AA policy was still running as they didn't cancel. Only mentioning this because they can deny any claim you might need to make if you give them a reason. Could potentially cause you major problems if they cancel the policy.

I agree, reinsuring whilst another policy exists is going to cause even more problems.
